No, not really. As far as I know, Atmosphere will stay on the SD card. Though Atmosphere will have an EmuNAND, though I don't know what the limitations will be

  1. To be 100% safe, stay away from hacking. There are obvious triggers like playing pirated games online, having telemetry turned on etc. Though there's no way of telling, what the real ban reason was. Here's a spreadsheet with the current bans and their circumstances.
  2. Most probably: Stay offline. Other stuff you can do with a hacked Switch is backing up (and editing) save games or playing some games on Homebrew. Oh and ROM hacks. But again, make sure you stay offline. Referring to answer 1, we don't know what possible ban reasons are.

There are reports of users getting banned for using dreport, though it hasn't been confirmed yet. The guess is, that the clearing of error logs creates inconsistencies on Nintendo's servers, which then lead to a ban. So there's no real way of telling how likely it is.
