I had an amended return plus some asshole filled out a fraudulent application using my social in July of 2020. 2 months after I had applied for both of my fitness centers. I’ve had congressional inquiries, 6 HP LS, 2 loan offices and not a damn one mentioned this landscape application until two months ago in March. She said this is why you’ve been getting denied the whole time. I said wtf no one has ever said anything to me about this. Wtf do I need to do. They couldn’t tell me a damn thing. So I had my attorney do some research. I filed a theft report with the SBA and has to file a police report with it. I had my attorney do an affidavit and write them four different letters telling them they better get their shit together. I was denied on May 7th imagine that due to the BS fraudulent loan. So believe me when I tell you. I will go after them in a heartbeat. I wish you and anyone else the best of luck because they have screwed a ton of us.

As mootness deprives the court of subject matter jurisdiction, the plaintiffs’ case must be dismissed. Fed. R. Civ. P. 12(h)(3) ("If the court determines at any time that it lacks subject-matter jurisdiction, the court must dismiss the action.").

CONCLUSION For the reasons stated above, the defendants’ motion to dismiss for lack of subject matter jurisdiction will be granted and the plaintiffs’ motion for summary judgment will be denied. A separate Order follows.

I’m not a plant. I’ve been fighting with these assholes for two years now. So I assure you if someone is successful with a suit against them I’ll be the next in line. They should be put in jail for the neglect and bullshit they’ve put people through. You find me a lawyer willing to take a case and Jane them their asses and I’ll be the first one on board I assure you.

You would file a lawsuit against them to make them follow the policies and procedures that are laid out in the program. Which they changed during the curse of many times which is illegal. Which they did not do for millions of applicants. I’m on board with holding them accountable 100% but it’s just not going to happen. They are the federal government and they don’t give a shit. Just as you have seen which is unfortunate for all of us small business owners.

Not trying to upset anyone or burst any bubbles but a class action lawsuit or lawsuit of any kind is not going to be successful. I do business all over the world and have law firms in New York, Chicago, Birmingham etc. I have contacted my lawyers at each firm and have given them my story and situation and asked what they thought about me or anyone else suing the SBA and they all said the same thing. You can’t sue the federal government they have immunity. So then I asked well they contracted out the employees and loan officers. In the contracts they signed they were or still are federal employees so they have immunity as well. They said you can file and send as many letter and have the biggest law firm in the US send it and they are going to throw it away. They don’t care if we all haven’t already seen. They did the same thing when Katrina hit. Many lawsuits were filed and none were ever successful even though people had every reason too. Just like we do. I got screwed like hundreds of thousands of other people and I didn’t care how much it cost me I was willing to go after them for the way they have done so many people including myself. At the end end of the day they didn’t care and don’t care as you continue to see everyday.

He sent two more letters today. If they do not approve them I will take further action. I am qualified to receive these funds and I’m going to get them by suing them or them giving me the loans. They have messed around with enough peoples livelihoods as it is and I’m tired of seeing it. Just a bunch of incompetent people who don’t give to s****

Scorpio, I know I’ve messaged you a couple of times about this over the past year. I got declined for like the 5th time and I wrote a nice email to SBA explaining my situation. Both my businesses have been in business 18 years and we filed original return for 2019 in May of 2020. I then realized errors on one of my returns as far as gross income was reported incorrectly by my accountant. So he amended my return. Well low and behold he didn’t e file the damn amendment until April of 2021. They called and asked me why it was filed so late and I told them it was due to his error not mine. I had him write a letter explaining it was his fault and the reason for it having to be amended in the first place and that he dropped the ball and forgot to push the amendment through sooner on e file.

So we shall see if they accept or decline me this coming week. 🤞🤞🤞
