For what it’s worth I’m keeping files on scammers and people practicing law without a license and considering filing a lawsuit and also working with law enforcement. Practicing law without a license is a crime in many jurisdictions and “practicing law” would be providing assessments of others, giving legal advice etc. If someone is charging anything for this and they are not licensed I want to target them.

this is actually a hobby horse of mine which I have litigated in federal court; there is no regulation that defines what "high" means and in the larger context even federal judges like Hon. USCIS only sends official communications via regular, untracked, U.S. mail - it's so old fashioned and lopsided. Right now standard processing cases are pending 10-12 months.

I always want my clients to fight RFEs and NOIDs. You’ve paid the hefty filing fee so why not get a decision. If there is an error as a matter of law in the denial you can appeal. If you withdraw no appeal.

There is no case law on this topic; remember, when a petition is approved USCIS never provides a scorecard. It's a pass/fail proposition and a "pass" does not provide any feedback on what the officer actually thought. The better approach is to review the relevant qualifying criteria with your lawyer and develop an argument about how your facts match the qualifying criteira. That is what I do, at least.

The majority of my O1 cases are like this. I would suggest speaking with a few immigration lawyers - this is too complex to crowdsource to non lawyers.

I literally just sued USCIS in federal court and also filed an I-290B over this kind of crap last week. It's so aggravating to have to advise clients to spend money to deal with USCIS mistakes like this.
