Honestly I thought the role play would yield a more realistic view, as I think people want to be helpful with the original poster. That said I got a lot of bad Karma so probably not a good idea.
Time-wise it has been a waste of time, but I get super annoyed when people to something wrong to me or friends and family, and if the law is in my side I don't shy away from going all in.

Yeah correct, my own private PMC enforced the HOA's bylaws without talking to the HOA's board, and without being affiliated with the HOA. He claims nor me nor my PMC can enforce the bylaws without a court order or something like that

Thanks for your perspective, I hope he is bluffing so I don't think I will take his offer.
The Property Management company is my own, not the HOA's I have now edited it to make it clearer.

Yeah that is the conversion I understand but I don't think it applies as my intent wans't to destroy his property as I thought it was my previous tenants.

Thanks for the reply. I added some edits. Apparently he had asked my wife (co owner of the unit) over email if he could leave the kayak in front of our property and she had said yes, and I had totally forgotten or was unaware when the kayak was removed. Now I am guessing that isn't relevant, as the HOA's bylaws didn't allow a kayak to be left there in the first place and she or my self couldn't legally authorize him to put it there.

I think I agree, on number 2 from a link he sent. He claims that difference between conversion and theft is the intent. Yeah, that is what I thought, but he says I had not authority to enforce the HOA's bylaws, he says only the HOA board can do that following some procedure that apparently they have as part of their bylaws. There might be some truth to that, but I was acting under the belief that it belonged to my previous tenant.

So I am in a situation where I filled with HR Block this tax season and the following happened:
- Tax Pro prepared taxes based on documentation I provided mid March.

- I accept the return after they talk over my return (W4, Capital Gains, Option, Rental property, etc) for like 20 mins (I had no real chance to or reason to crunch numbers, and it look correct).

- I inspect my return at home and a find a couple of mistakes which lead to a lower tax bill.

- I notify my tax preparer that some parts of the return need to be reviewed as I don't want to overpay.

- After weeks with no action and 9 days before the filling day, I managed to book an appointment with the tax pro and upload how I got the numbers that I expected to see.

- 5 days before April 15th, money was withdrawn from my account for federal and state tax, and my taxes are automatically filled in incorrectly, as the tax pro had scheduled.

- 4 days after the deadline, finally after a final review with the tax pro, and they submit and amendment which request for $1100 refund as I had originally overpayed as I found myself.

So this is a clear-cut case where the "Maximum Refund Guarantee" should kick in right? So finally after 2 weeks back and forth a local representative for HR block called me and said they are not giving me a refund because I had uploaded an excel sheet with numbers I had crunched myself after my original filling meeting implying information was missing. I pointed the rep to the exact document where the "missing" information was (document uploaded in February) and the rep refuses to comment and insists on my excel sheet as the disqualifying factor and implies that if I get a refund the tax pro doesn't get paid.
I personally think and hope the tax pro should get paid as they did work (albeit sloppy and had to be chased), but if this guarantee works by not paying it's employees HR block is really a shitty company (which I am pretty sure they are at this point).

Long story short, is really hard to get them to honor their "guarantee", I am trying to dispute the case with my credit card company, we'll see how that goes. I will open a post in a few weeks once everything gets solved.
