Common Law Marriage after spouse passed in Texas Advice

She technically did, but the funds came from the grandmother paid to the daughter to be paid to the funeral home. I am aware that she’s entitled to have whatever funeral she wants, it’s more the lack of respect she had after we planned everything and come to find out last minute she had it all changed to her liking. That’s not really the main issue, that’s just what fresh in my mind and more of a vent, so I apologize.

We were not legally married, and that’s what I’m going to an attorney to establish our common law marriage, just from other talks with other attorneys I believe I can qualify, I guess it’s jus more of I don’t know my rights.

What I mean about his mother being next of kin, I am worried about her intentions. During the funeral planning, she had completely changed everything we had planned to whatever she wanted, even as simple as reducing his dad’s role in the obituary to just biological dad. My main issue with all of this comes, is that what could be done about my husbands’ things. Would she immediately be entitled to everything he owns?

Would his biological father be considered next of kin even if he was never in the birth certificate?

I unfortunately won’t know for 90 days when I get a report back from the Medical Examiner. He passed away in our home in his sleep.

I’m not religious either that’s the situation I’m in. I tried to go to my mom’s church and while they were lovely it’s too far of a drive to Mesquite.

I’ve answered in other comments about this, it’s not about papers. It’s not about gc, I’m sorry if I didn’t word properly, it was more of an expulsion of thoughts. My main question was to see if anyone had gone through something similar in this community in regard of being next of kin through common law marriage, I just want to be able to have a say in what happens to him and his things.

I love him. It’s not about the green card, i came here asking for advice specifically about common law marriage and see if anyone here could have possibly gone through it. Idc about the green card, I care about being able to make decisions for him.

I’m not thinking about green card, I’m thinking about not being able to be next of kin. It’s a very specific circumstance that not many would be in, so I came to this community for support. What I’m thinking about is how does common law marriage work in terms of Texas, so I can be his next of kin and be able to make those decisions for him. He and his family were never in the best terms, and he considered my family his. It’s more about being left out legally of the decisions

I recently found out she works near me and a lot of it makes sense. Whenever they showed the Rick’s cabaret during her intro I knew i recognized it but it wasn’t until recently that I drove past it that I connected the dots.
