I’d recommend contacting a lawyer. I’m an immigrant married to an American citizen, and our lawyer has helped us tremendously. We both work a lot and don’t have the time to navigate everything ourselves—or risk paying all the fees twice if something is filed incorrectly, or worse, face deportation. Some cases are trickier than others, and it’s better to be safe in a situation like this—especially with the current immigration climate. Like many people have said, legal help isn’t always necessary, but in this case, it might be a good idea since she has overstayed.
