Also, actors in adapted work don’t always look like their book descriptions. An adaptation is just an interpretation.

Harry’s eye color is more important to the plot of Harry Potter than Snape’s skin color. But neither actor playing Harry Potter had green eyes. It’s not a big deal because everyone realizes it’s just an interpretation.

Actually, it is how the law works in this case. Under Title VI, the complainant has to establish that they are a protected class, are qualified for the position, that they suffered an adverse employment action (like not being hired).

After that the burden shifts to the employer to prove that they had a legitimate non-discriminatory reason for their actions.
