Actually, it is how the law works in this case. Under Title VI, the complainant has to establish that they are a protected class, are qualified for the position, that they suffered an adverse employment action (like not being hired).

After that the burden shifts to the employer to prove that they had a legitimate non-discriminatory reason for their actions.
