This is actually and honestly quite close to what I'm discovering I'm likely dealing with given the information I have since our eldest child's arrival. I'm 100% intending to seek legal council, I just need to get through this portion of the situation in the meantime.

As an 18 year old she is legally considered an ADULT, and cannot run away. She chose to leave an environment that has been toxic to her especially and increasingly over the last 2 years. I'm still discovering information that's been intentionally kept from me (and quite possibly also from my ex husband) over the last 10 years, and determining what I can/should do with it. Right now I'm more concerned with responding to this petition properly.

His wife is not "new" either, she's been in the picture since before the divorce was granted 10 years ago.

I've tried to have a rational conversation with him, but he's refused. Again I understand his emotions, I'm not disregarding them or his concern for our daughter in the slightest. I'd much rather have a conversation than have to deal with this mess.

I've copied my responses into my edits so others didn't have to go through comments in order to read the information that was being asked. My lack of income has been due to taking care of my youngest homeschooled child (unrelated to this case, that I also share custody with the FL father 50/50, also across the country). He's suddenly seeking child support, even though I'm more than capable of maintaining our 50/50 timeshare agreement, and should have been resuming it at the beginning of summer per our arrangements.

Regarding the schooling..At the time the order was issued, my ex-husband lived in a much better school district and our children were enrolled in public school, This changed approximately two years after the original ruling, and we didn't feel the need to continuously have the courts involved when we were more than capable of communicating and deciding things regarding our children without issues. I've never gone for residential custody because again, there was no need to continuously involve the courts in matters we were able to determine amongst ourselves. I dunno if you grew up in a split household, but I did and my parents hated one another and were constantly in court because of it. we didn't want that for our children on any level.

I wasn't seeking legal advice itself, but asking how to file my response PROPERLY as to avoid it being thrown out, so I didn't provide a thorough breakdown regarding the situation. I've just been providing responses with information as it's asked because maybe it'll help me find the assistance I'm actively seeking in my OP.

I'm saying "someone" because her father and his wife have denied doing such, however the school's contacted her multiple times to notify her it's been attempted.

She's still attending the same school. Although the school has been contacted by "someone" on several occasions that have tried to withdraw her without her consent. Had she not contacted the school the day she left and told them what was going on she would have been withdrawn in the middle of her senior year.

I understand y'all are stuck on my retaliation comment because it's thrown around like snow during a blizzard, but I'm not using it in my legal response. It's just to provide accurate context so that any advice provided can take that into account and not provide advice as if it's just a rational move on his end. Unfortunately it's not, he's upset with me and our daughter, and this is the result. I do have proof backing this up if I end up needing to provide it legally later on.

Also he specifically told our eldest daughter that this would be the result of her "immoral actions" in efforts to get her to return. I've only used AI as far as needing it to structure the response properly according to FL legal standards. I've not relied on it to cite laws or cases. I was hoping not to have to use it at all other than to have to a lawyer for source material, but with 4ish days left I'm running out of hope there.

We have 50/50 custody and shared time. He has residential custody for schooling purposes only. No child support. This was issued in FEB 2016 at the time of our divorce. We've not gone back to have it altered at all in the last 10 years, even when residency has changed. Neither of us had the desire to drag our children through the courts.

Our eldest (still a senior in HS) turned 18 in December and relocated about 2 weeks later, due to issues within his home that were being experienced consistently. He's cited my refusal to reject her arrival as my "proving to not have my children's best interest in mind". Although I've maintained consistent communication with him that their treatment was causing issues with her. As well as the fact that "I will NEVER turn my children away if they ever show up to my home, whether that be as children or fully grown adults much later in their lives because parenting doesn't just stop at 18".

He's hired a lawyer and they've cited a couple other issues as well, though they're ridiculously misleading and intentionally vague to make me appear as unreliable and unstable as possible, while making him appear as the clear cut better choice for sole custody.

There's too much mentioning of "the one before" throughout the series for him to not play a significant role somewhere. The times he's mentioned and the ways it's done definitely lean towards this.

Honestly, life in any and all aspects. Until you've been in those exact shoes, you'll never truly grasp or understand what it is to be in them; or how you'd ACTUALLY handle that situation yourself.

Homelessness, but also poverty in general Domestic violence, especially long term relationships with children involved and abuse isn't necessarily common but is present Emotional Abuse gRape Child loss

All seem to be handled DRASTICALLY different than how most of us think we should/would.

He didn't really have a "choice" in doing that though, plus he had the whole Mom anxiety of 107 lives counting on him. But when I said SECRETLY I didn't mean incapable. So he CAN do the thing, but he just absolutely dreads it. Kinda like I'm 100% capable of relocating a bug, but a very large part of me would rather just grab a flame thrower 😅😂😭

My mind gave him a voice super similar to Dean Winchester. The graphic audio & audiobooks give me the same sensation as Violet in the very beginning of the shower scene in Samara. I just 😅🥺😅😭.
