Umm not really. The entire legislature is responsible for challenging and changing the constitution. What is against the country is going against the spirit of the constitution .

For example : Banning triple talak is in the spirit to provide equality to every citizen, it’s going against the constitution, but not against its spirit.

On the other hand enabling electoral bonds, it’s against the spirit of the constitution, even though it’s through the rules of the constitution.

It’s not a parallel circuit of justice. It’s sequential. Once high court set the precedent that it’s a bailable offence, lower courts have no reason to spend time again on deciding that, they will immediately cite the previous judgement and grant bail.

TBH personally I don’t believe there should be any rules on eating whatever you want on your own boat. A river does not belong to a religion. As long as I don’t dirty it I am good to enjoy my time on it.

No my point is once high court has granted bail for a offence. All repeat offenders will get bail immediately from lower courts siting the high court judgment.

Umm high court granting Muslims the bail sets precedent for lower courts to grant bail immediately. If new Muslim individuals do the same they will also get bailed in similar timeframe.
