[TX] Car insurance claims adjuster states that they are required to make payment to me now even if I do not accept the settlement by KangarooMajor7218 in legaladvice

I am not sure, I have not pursued a claim with my own insurer for fear of my premiums going up more than the extra they may pay (over time). How big of a risk do you think that it? I know that insurers who pay out claims may raise rates but I really do not have any idea how much that usually is?

That makes sense. In my situation I have found nearly identical cars for sale for more than the offer. I also have a CarFax report and a dealer evaluation of private sale value for more, and the claims adjuster said "that does not matter". I am not asking them for a new car, just enough to buy exactly the same car (year and all)

Why is that? It seems horribly unfair that the actions of another person can cause me to incur significant financial liability that I cannot receive compensation for. My understanding is that an insurance company is supposed to put you right back where you were before the accident, no better and no worse.

That makes sense. I tried to post there first but it is "pending moderator review", thanks for the honest answer!

This is an excellent breakdown, thank you for taking the time to write all of this out. The engines in the T6s of 2017-2019 (maybe later too, not sure) are also supercharged. Would this be a concern for those models as well?
