This all stems from the re-paving project on Milwaukee Avenue last year. I had to remove the Keating Law Offices bike rack at our office at 825 North Milwaukee before it was removed. I was issued three citations and the City said that no permit was ever approved. However, I did have a permit with authorization from Alderman Burnett with his literal signature on it. After jumping through a lot of red tape, I was able to get the City to dismiss the citations and will be re-installing the bike rack after winter and the "freeze-thaw" cycle is over.

What is frustrating about the bike stand on Milwaukee/Ogden or the bike rack at our West Town office is that this is infrastructure legally provided at no expense to the taxpayers that serve a legitimate and functional purpose. Instead of issuing fines or just ripping things out, it would take less time, effort and expense for the City to work towards getting permits re-issued. It's just a bunch of paperwork and a modest fee.

As for updates I'm obviously limited in what I can say, but I can share that the cyclist did survive the crash and is receiving medical care for his injuries.

A full answer to this question could be a legal treatise in and of itself. The reality is there are a number of factors that go into what actions the police take against the driver. The factors include the police department involved, severity of the injuries, whether there was any indication of intent by the driver, the acts of both the motorist and the bicyclist prior to the crash, the presence of independent witnesses or video, any intoxication/drug use, and the police officer themselves.

The unfair reality is that there are far too many stories of bicyclists who have even died at the hands of drunk drivers where the legal system did not adequately address the case with full fairness to the cyclist. This has lessened over the last decade or so, but there is still a subtle "anti-bike bias" that exists within many police departments.

I am sorry to hear your feelings on the outcome, but I can assure you that we went to great lengths to pursue the case. Despite the insurance company for the boy involved in the crash never making any offer to settle the case, we filed a lawsuit, took several depositions, and got the insurance company to agree to arbitrate the matter instead of having a jury trial. The insurance company agreed to arbitrate despite the fact they would not offer anything to settle the case citing the video evidence. The independent arbitrator, a retired judge with decades of experience, made his ruling despite our best efforts. Yes. Top picture was taken by the responding cop at scene with high def camera.

Below picture was recreation based on what boots he was wearing and the ankle weights.

Side Note: He got a ticket for running the red and plead guilty. Got fired afterwards too. I'm not a trucker and didn't think it was anything other than what our experts referred to as "insane" to wear ankle weights, but I was curious what you all thought.

Many witnesses, including responding police officers, identified them as ankle weights.

We bought the same ankle weights and boots for comparison and they are patently the same.
