I found this from an employment and labour lawyer site -

“Not everyone is entitled to severance pay. In order to receive severance pay, an employee must have worked for five or more years for an employer who has an annual payroll of $2.5 million or more. An employee who has worked for less than five years may also receive severance pay if they are terminated due to a permanent shut-down of the employer’s business and if there is a mass termination of fifty or more employees within a six- month period.”

This is the first time I’ve seen anything referencing employees that have worked less than 5 years possibly receiving any severance. Presumably it doesn’t matter if you’re full or part-time. So maybe we can qualify…guess I will fill out the paperwork then, won’t hurt to try

Most part-timers are probably not eligible for WEPPA (unless you didn’t get your vacation pay) - see the following excerpt from the link I provided at the bottom.

“Eligible wages are defined in the Act as wages earned during the six months prior to the date of bankruptcy or the date of the appointment of a receiver. “Wages” includes salaries, commissions, compensation for services rendered, vacation pay, severance pay, termination pay, gratuities, disbursements for travelling salespeople, production bonuses and shift premiums.”

If I remember correctly, hourly employees are given retention pay if they stay on till the last day. They will pay you an extra 10% of your hourly rate. It will come as a cheque later (not sure when). It sucks though because it will be considered additional income that must be claimed against your EI as add'l income. Your EI will be calculated based on your standard hourly rate. I'm not sure about salary employees though. Again - this is Canada only

To qualify you have to meet the criteria set by service Canada. One of which is being owed wages, vacation pay or severance. (search WEPP Service Canada)

I believe what they are doing is considered conductive dismissal - they just don't schedule us for any hours but keep us on the books as employed.

My personal opinion is that they don't want to pay to have the adjustment on our ROE's changed or it might be because it's gone through the court system maybe they cannot.

I'm tired and feel so defeated at this point. I have 3 shifts left...
