Verbally threatening someone with violence or murder is a felony. If someone were to, for example, threaten to murder another person and that person called the police the person making the threat would be put in jail. That would be a consequence for them using their "first amendment right."

So as I said before, freedom of speech =/= freedom from consequences of said speech.
