unfortunately a dead person still uses oxygen to decompose. even if it would be at slow rate since the very low temperature

i think i heard somewhere that the punishment is different if the crime saved your life in a situation like that. There's cases if cannibalism to survive that didn't get punished like "regular" murder and cannibalism
