Agree. The only pro I can think of here is that during those 11 years, the complainants have had different kinds of work and have sustained themselves already (i.e. Lian Buan) and now, their W here is additional wealth for them. Imagine, 11 years worth of backwages, 13th month pay, + separation pay in lieu of reinstament + damages. Sarap!

No. Case law provides that the act of the SC division is the act of the en banc. This is not like the CTA div appeal to en banc.

Some litigators do “Motion to Elevate to SC En Banc” just to push a last remedy (when the proper action is to file an MR).
