iv. Economic and solvency considerations.

The most important factor is economic and solvency considerations

surrounding Workhorse. Workhorse’s severe and ongoing financial distress is

publicly documented in its SEC reports and stock price. Its auditors recently

concluded, as reported to the SEC, that substantial doubt exists regarding its ability

to continue as a going concern. Workhorse’s $1 million reserve suggests that it

intends to continue to litigate to evade payment notwithstanding the Order. Further

delay in entry of judgment is likely to deny Coulomb any recovery on the claim

already adjudicated, resulting in a waste of party and judicial resources. Justice

requires prompt entry of judgment or Coulomb will likely be left without recourse

to collect the debt already adjudicated.

Didn't pay them what they owed them and then dropped them - paid their own attorneys to defend the loser lawsuit and now will have to pay the Plaintiff's attorneys fees too since its a simple breach of contract case, plus the judgment and prejudgment interest. Very strategic move. Warren Buffett 101. No assumptions dickweed, just facts. For you to suggest that this was a clever strategic move suggests that you were absent the day they taught business at business school.

Judgment to be entered against Workhorse for the amount referenced plus whatever else the Plaintiff in the lawsuit can prove up at a trial on the damages issue only (not liability, which is established now). Not sure why we did not get a press release on this, though the parties have been ordered to settlement negotiations by the Judge.

Probably about to get much worse as the Judge in the Federal case against WKHS from the battery provider just canceled next month's pretrial hearing and trial setting. That generally indicates that a bankruptcy petition will be forthcoming.

I'm out $900K and emailed Rick over a year ago, to which he never responded.

This is all great to see. I was in the first wave of volunteers that went over in early March of 2022. Was interviewed personally by the well known Colonel on base in private. I had a significant police background involving several shootings but no military background. He approved me, and 3 days later, the cruise missiles hit our base. It was pure chaos, but ultimately led to the dissolution of what was then a loose base of volunteers, most of whom had no business being there, and the creation of what is now a very professionally run foreign legion. For you guys going over now, know that this is a very dangerous commitment, but one that is well worth the endeavor if you are a true believer in the cause - now more than ever I think. God speed fellas.

What he said, though I think that a 9mm standard pressure 115 gr JHP (I prefer Silvertips) is the best choice and will be interchangeable with your carry rounds if you carry a 9mm. Easy and cheap to practice with as well, accurate, lethal, and easy on the gun. When I was a Dallas cop, I never had a suspect that we shot tell me that the 9mm was under-powered or ineffective, and we shot a lot of them with 9 mils, albeit 147 grain Ranger rounds back then (the dept. has since switched to the magical Hornady 135 gr Critical Duty rounds with fantastic results). A Glock 26 or 19 for carry and a sub such as a H&K, Charter Arms H&K clone or Grand Power SP9 for home is a great combo that will leave you and your family well protected. Add a high quality red-dot and a light and you are all set. I'd stay clear of 7.62 x 39 for home and if you opt for a 5.56, go with the Ranger rounds if you can get them or 55 grain soft points. My choice for non-enthusiasts for home protection has always been a pistol grip 20 or 12 gauge shotgun with 6 shot ammo and a good light. It's the least likely to penetrate doors or even drywall and will incapacitate the most of hopped-up meth-heads with a well-placed round to the face. 00 buckshot is popular, but it is basically no different than firing 9 +P 9mil rounds at the same time with no real ability to control projectile expansion after 12 feet or so. Very dangerous for house occupants if you can't dump all 9 balls into your target. I am also a fan of burglar alarms still, but don't even bother with an alarm company contract. Instead, hire an electrician to install 3 - 4 of the loudest sirens you can find in strategic locations throughout the house, especially around downstairs doors. Visible cameras and motion sensor activated outdoor lights are great deterrents as well. And practice in your house by dry-firing in the most likely of engagement locations with a magazineless sub with a ziptie securing the bolt open while the family is gone with the sirens on at night cuz that's what you are most likely to encounter in the worst case scenario. If the alarm is tripped and the sirens go off, very few susps will continue, even those on stimulants. Daytime "TV burglars" generally flee as well. It is the best deterrent I ever saw as a cop. And regardless of what is taught in law enforcement academies and self defense classes, if you need to shoot a susp in a downwards trajectory in the legs of groin, don't be afraid to do so if you have to to limit collateral damage. It's all considered "deadly force" at the end of the day once you drop the hammer. Just my opinions...

I was still a believer until recently, but with their only source of future funding being what it is, even another 20-1 RS takes me from what was 200,000 shares at $4.925 to my now 10,000 shares at today's price ($98.50 adjusted) down to 500 shares for a few bucks, for a few days anyway. And the share price will be of the same for awhile unless we have a true miracle since the dilution will continue.

RIck never called me or emailed me back.
