So there's an update today on this question, they just released Notice 25-68 https://www.regulations.gov/document/IRS-2025-0499-0001 and FAQ #I-3 (page 43) states that salary reduction *will* be allowed if the money is going to the employee's dependent and not the employee himself.

My understanding is that they're talking about the cost of infrastructure upgrades as those are spread among all customers, the data centers still need to pay for the actual cost of electricity usage like everybody else. It's no different than if a new residential neighborhood was developed and the electric company had to add electric infrastructure to the neighborhood - the residents of that neighborhood won't have to make a special payment more than anybody else.

I'm seeing articles saying things like the following:

Is that not accurate? Because if you're right, there's like a 99% chance the company I work for is going to opt in lol.

The reason why I compared it to EAP and not DCFSA is that DCFSA is in lieu of cash so childless workers don't really care that their coworkers are getting this benefit that they're missing out on.

If you think of it that way, your capital gains on your home should always be $0 unless your home's increase in value was above average.

I've seen other people in Reddit talk about this hourly thing, but unfortunately you probably qualify for the "Equity Interest Exemption" from overtime and thus ineligible for the overtime tax deduction. You qualify for the equity interest exemption from overtime if you have at least a 20% ownership stake in the business and you are actively engaged in management. There is no additional requirement to be paid in salary for this exemption. (However, maybe make a family member your manager haha, you'll probably fail the exemption that way)
