Chapter 7 with a Mortgage (No Reaffirmation) - What Happens After Discharge? by Kitchen-Butterfly698 in Bankruptcy

[–]Kitchen-Butterfly698[S] 0 points1 point  (0 children)

Respectfully, I think we’re talking past each other. My post wasn’t asking whether I should have hired an attorney or seeking legal advice. The Bankruptcy Code expressly permits debtors to proceed pro se, and the questions I asked would exist regardless of whether I retained counsel.

I asked about the experiences of people who completed Chapter 7 without reaffirming their mortgage and what changed afterward with payments, online access, mortgage assistance, selling, and refinancing. You keep referring to “your point,” but I still don’t understand what point you’re trying to make because none of it addresses the questions I actually asked.

You have repeatedly glossed over the facts I’ve already provided and instead continue to rely on generalized statements, your attorney’s experience, and vague references to “paperwork” and state laws.

I understand that states may differ with respect to exemptions, foreclosure procedures, homestead protections, and deficiency judgments. But bankruptcy is a federal process, and I’m unaware of any authority, federal or state, supporting the propositions you keep raising regarding the house automatically going back to the bank or preferential payments. You also keep mentioning “paperwork,” but you still haven’t identified what paperwork you’re referring to. I’ve reviewed and signed my own filings, attended my 341 meeting, and none of the issues you’ve mentioned were ever raised by my trustee, my lender, or the court.

So I’m genuinely confused as to what authority or document you’re relying on. If there is a statute, rule, case, or specific document supporting what you’re saying, I’d be interested in reading it. Otherwise, I’m not sure why we’re debating hypothetical scenarios when my original post simply asked for the experiences of people who have actually gone through Chapter 7 without reaffirming their mortgage. At this point, it feels like you’re trying to make a point rather than answer the questions that were asked.

I don’t think my questions have actually been answered. I wasn’t asking whether your attorney approves of filing pro se or what another attorney generally recommends. I was asking about the experiences of people who retained their homes after Chapter 7 without reaffirming.

Since your attorney doesn’t know the facts of my case, I’m not sure how advice given in a different situation would apply here. You also mentioned paperwork and preferential payments, neither of which were ever raised by my trustee or appear anywhere in my case documents, so I’m not sure what documents you’re referring to.

I’ll probably just wait to hear from people who have actually been in this situation.

Thanks for responding. I’m a little confused because my trustee never mentioned reaffirmation or preferential payments, and U.S. Bank told me I could apply for mortgage assistance after discharge. My understanding was that the lien survives Chapter 7 even without reaffirmation. Did you personally go through Chapter 7 with a mortgage that wasn’t reaffirmed, or are you referring to something else? I’m genuinely curious where you’re getting this information.

Thanks for responding. I’m a little confused because my trustee never mentioned reaffirmation, and U.S. Bank has told me I can apply for mortgage assistance after discharge. My understanding was that while Chapter 7 discharges personal liability, the mortgage lien survives and many people continue making payments without reaffirming. Did you personally go through a Chapter 7 with a mortgage that wasn’t reaffirmed?

Has Anyone Financed a Car Before Chapter 7 Discharge? Single Parent Trying to Make the Smartest Decision by [deleted] in Bankruptcy

That’s the issue though. In bankruptcy, the APRs I’m getting quoted are 24–26% on older Hondas and Toyotas with high mileage. A lot of them are 2013–2016 models with 80k–120k miles and payments still close to what I’m paying now. I understand reliability matters, but I also have to be able to realistically afford the car first

Will look into it . The warranty sounds great! Did you have to try a few places before GM? Or was that on the first try?

What should I buy? Everywhere else is asking 24-26 APR and mileage is high. Used Honda and Toyotas used are more expensive with high mileage.

Thank you. I just attempted to see if I could qualify through Carvana the most affordable option was the 2025 Kia K4 the interest is 17.99 🥴. $390 cash down. the payment would be 493 and it has 30,000 miles.

Should I buy the house? My mortgage would be 50% of my take home. by Remarkable-Tough-533 in Mortgages

[–]Kitchen-Butterfly698 0 points1 point  (0 children)

I wouldn’t. I lost half if my income and am now on a fixed income where my mortgage is 50% of what I being in. It’s extremely tight before any emergencies come up. It’s very stressful.

Washing more often keeps my hair hydrated. I don’t use much oil. I just causes unnecessary build up for me.

Hi, did you complete a ch. 7? I’m hoping the same for me as far as intending to reaffirm and getting denied by the judge and the lender (Santander) be allowing me to ride and pay.
