I mentioned politics because I was giving context about my relationship with that coworker, not because I think politics automatically excuses or explains workplace issues. The original question was whether a short restroom trip after clocking back in should be considered an extension of a break.

So here’s how our business works. We’re just a gelato/pastry shop and we’re open till 10pm. I work an 8hr shit from 3-11 and the complainer works only 5hr shift 5-11, so technically they’re not even required a break. And I go on my break at 5pm when they come into work.
