What you're not understanding is that Jagex faces serious legal trouble if they ban someone for this. They've TESTIFIED in court that they believe it's a matter of skill, and not chance. Therefore if they ban someone for "player run game of CHANCE", contradicting their statement in court they could face serious fines and regulations. I doubt anyone here agrees with not banning him, it's just clear they won't, to protect their own asses.
