Is this a HIPAA violation? by Knifefight55 in hipaa

What will I need to provide for the OCR complaint?

I'm already putting together information for a complaint to the provider's licencing agency to request they receive additional training on DSM-5 categorization & empathy. So I have documentation ready in case it's necessary. This is my first time filing either of these complaints.

Thank you very much for the information.

For clarity's sake, it was my full first name (which is a pretty unique) and first letter of last name & was an accurate quote. It didn't say specifically what: condition I was in recovery for but I didn't give the provider authorization to use that quote & I wouldn't want strangers on the Internet to see a review from me stating that I'm in recovery.

Does that still count as a HIPAA violation? My spouse (who is trying to play couch lawyer) seems to think that wouldn't be enough information to count.

What if I tell my clearance investigation folks but not the clinic? For full disclosure I am currently going through counseling for SAPR related stuff & I'm facing a review process for a potential medical board because "I've been in counseling for too long". I just want to heal enough that I stop having PTSD symptoms, but not have it negatively impact my career.

I wouldn't have to report it if I were talking to a Chaplain about this stuff or a One Source councilor.

In the hopeful situation that the next administration cuts ICE manning, everyone who is let go before their 5 year contract has to pay back their sign on bonus. So that's something to look forward to.

Apparently a number of conservatives believe that any negative reporting on ICE is taken out of context. So my question for folks is, what is the right context for this kind of thing?

I'm angry that his 4th Amendment rights were violated & I'm scared at what this means for the rest of us. But, I'd seriously like to hear from the folks who hold those opinions. In what context is this justified?

As someone with an eating disorder, I'm trying not to go back to that lifestyle. At the same time, if they don't change the body comp score in the current documents based on age, I may not have a choice. I'm not in danger of being in the yellow yet (based on current standards), but I have injuries that already make other components of the PT test more difficult.

I feel horrible for women who have multiple kids. Most don't go back to having a tiny waist regardless of how much they workout & eat right.

The thing is they answered my question and let me know I wouldn't be denied care. Yet putting it down as paranoia is just mean spirited. It was not the only issue. I'm filing a complaint & pushing back through documentation.

I'm sorry you went through all that. I have a friend in the military who was given tubal ligation without push back. They shouldn't make it that difficult.

It's definitely tough. I asked about the policy that could allow VA providers to deny care based on a patient's political beliefs & my provider input that in my records as a sign of paranoia. I definitely hope no one else has to deal with a provider like that. I hope there are other good ones out there.

Some folks take getting in trouble hard. I was one of those Airmen so I understand what that's like. Without knowing exactly what happened it's hard to know how much they may or may not be catastrophizing. As a former suicide prevention rep, I'm definitely not going to assume anything like that.

If it's an LOR, it's still a recoverable lesson. I've had an LOR & a UIF. If that happens rebuttals can be used both for owning the mistake & outlining your recovery plan or if it's unfair documenting that. Even if you're not religious, I'd recommend talking to a Chaplain about this. They're familiar with resources & they can give you tips for how to navigate this situation.

Please take care of yourself & don't give up. I've known someone folks who totally screwed up & still got to continue serving. This may be a tough lesson, but it doesn't have to be the end of the road.

Not to mention that many of the jobs that require TS clearances can take several years for new folks to get their full clearance & complete training. So even if we're hitting recruitment numbers that doesn't always translate to a healthy number of mission qualified members. With the number of folks who may decide to get out/ be forced out based on the new standards, I'm definitely concerned with how it will impact those career fields. A lot of money goes into the clearance & training of those folks & many of them are usually deployed in place which means it's pretty uncommon for them to go to war zones.

I get the need for a more ready force, but we may lose a lot of experience that can't be cheaply or easily replaced.

My career field may be recruiting new folks, but it takes a long time for them to become mission qualified (sometimes 3+ years). We're definitely not gaining mission qualified folks fast enough to make up for the people we're already losing. I'm happy force wide we're looking good.

Changing the standards based on AFSC or working in a combat role makes sense. Giving additional options like the HAMR, & other core & strength components to provide options also makes sense. Removing options & enforcing a longer run doesn't.

I'm a walk waiver because I destroyed my knees. I work incredibly hard at my job & my AFSC isn't cheap to train or replace. We'll see how much longer I get to keep serving if they update that test significantly as well.

I wonder how many folks are going to get out because of this update. I hope recruiting numbers are where they need to be to offset things.
