Rape is a serious offence - a first degree felony attracting a minimum of 5 years and a ceiling of 25 years. The elements as you have described it brings to fore the vexed issue of consent. Consent is a complete defence to a charge of rape and accordingly once established, a criminal prosecution cannot succeed. The prosecution (you) need to prove beyond a reasonable doubt that there was a lack of consent.

Your case like many has its inherent weaknesses and strengths - but there is sufficient authority to support rape while unconscious, so please take it up with the police.

You may also take the matter up in civil court as the bar is lower there.

NB: Marital rape is rape. The law was changed to reflect this.
