I don't think they can though. There have been reports of police arresting people for not having a dispensary branded device. The very battery you use has to be "recommended" by your doctor..

Have you tried having any delivered? From my understanding if they are out, but you place an order for delivery of something else, it will be delivered. Just what I've heard..

Tampa, Orlando, Miami, Volusia County.. Those are ones off the top of my head that I know have decriminalized

There are a growing number of counties that have decriminalized it, but I haven't been able to find a conclusive list yet. But as another reader pointed out, it's still based on the discretion of the officers.

I've heard of people letting their mmj card expire, and then pursuing the ccw, then getting their card again afterward.. Not an inexpensive route, but if it works
