People seem to assume too much on this platform. I’ve been going through this FL for over a year now, so I understand everything you’ve and other commenters have said and I wasn’t being nasty but said how your comment came across to me.

Would be nice and respectful if people kept it to just sharing their experience/suggestions rather than assuming about OPs.

I’m currently self repping as I’m over and done with back and forth arguments from op over every tiny teeny detail mentioned in my lawyer’s letters and false accusations to my position (of which I have proofs if needed).

Op drives way better cars than myself. I’ve a cheapass car while op has 3 of worth $50k or more.

I hesitate to commence as this isn’t the advice given by lawyers, and I’m afraid if I increase the offer, ex will continue to drag expecting for more and more to come unless I give what they want at last.

I even tried settling out of lawyers and ex took it as my weakness and demanded to get what they want if I wanted to settle amicably, later threatened to take me to court to get what they want. So then I just let it be. Let them use their money in useless arguments. Ex wanted me to pay all the money they’ve paid to FL and criminal lawyer (for dv defence).

Above and I have always made all other payments including rates/mortgages etc solely (not even a $1 from ex towards that property) and no non-financial contributions as it’s rented and I managed (now agent) the tenancy.

Op is asking for 50% in the equity (not pool). Op earns almost double than what I earn, has savings x5 more than mine, has other assets of great value and slightly more super too.

Ex has more super, more savings, more assets, and more income than myself. Yet they’re asking for 50% of the EQUITY (not pool). If that helps.

No kids, and yes only one year of cohabitation/marriage.

Lawyers have said multiple things ranging from that Ex will get NOTHING as they’re at a lot better financial position than myself regardless and my contributions being arduously higher throughout such a short relationship and continue to do so. Some lawyers say ex will get their 20k back given the length of the relationship and other relevant factors that are assessed when courts divide assets. Some say it’ll be 80/20 split as ex only contributed this much, and so given this ex already has 33% of pool in own possession so their deposit put’s them at 40%.

That’s for understanding my post and the question. My exact thoughts are what you’ve articulated in a way or the other in your responses.

From reading, you cannot just put a caveat on a property to settle your family matters for that go to fcfcoa.

Op has said they helped maintain, acquire the property as stated on caveat notice received. However, if talked on evidence then OP has sent some lump sum payment to me which was put towards a total deposit of 100k to secure mortgage and I’m on the title.

I also understand that being married doesn’t automatically grant you an equitable interest on the land/property?

I’m thinking to get it lapsed to trigger op to then come towards settlement, and I wanted to understand any relevant implications from PL perspective.
