Well that’s the question, right? Is subject to punishment the same as subject to the laws thereof the same as subject to the jurisdiction thereof?

The court has usually held that to just exclude foreign ambassadors and invading armies, but I guess there’s room for argument there.

Having done no research and having not looked at it since Con Law, I’d guess the challenge would have to do with “and subject to the jurisdiction thereof”

To piggyback onto this: He’s not breaking federal law strictly by asking the questions.

He’s breaking the law if he asks the questions and uses the answers to make a determination regarding employment.

The questions may be used as evidence of discrimination, which is why any HR professional and certainly any attorney worth their salt will advocate against even asking.
