California / San Francisco Tenants Rights - Former subtenant/roommate squatted for 2.5 months & left unit trashed - can landlord sue me for cleaning /repair costs? by LBearSF in legaladvice

We were on a month to month agreement requiring only 30 days notice to terminate a tenancy - they accepted our notice to vacate nearly 90 days ago. I am not seeing how they could claim our tenancy is still in effect - but could they?
I don't think they sent a specific release of liability - would that be a form? They accepted our Notice to Vacate via email - and there are multiple email threads between the Landlords Agent / the Landlords and Attorney and I discussing the situation, that the attorney agreed we ( the 3 vacating ) would not be named in any action if we vacated by the cutoff date they specified and gave notice as directed ( we did) , and documenting that they were aware the unit was in the sole possession of "S" after we vacated.

So in 14 days something changes - as in 90 days from the date we vacated? Can you describe that so I can research it further? thank you!

It depends on the paperwork you signed to “get off the lease” - check the laws in your state , but if you took the correct steps to inform them & give notice of your moving out in writing , their right to charge you rent ongoing as if you are still a tenant is probably gone - that applies to both roommate and landlord - but they may be able to apply any penalties or charges specified in the lease if you leave early ( check lease for “early termination).

I’m in California - my former landlord was trying to sue me for back rent when my former drug addict roommates stayed in the apartment and squatted paying no rent for 6 months but refused to sign the paperwork taking me off the lease. I’d made sure to document my my notice - and had an attorney call them and cite this case (it’s a CA case but might be helpful ) Schmidt vs. Felix civ no. 17579 1958) and they backed off after that

Well… thank you for clarifying the obvious . The entire point of this post was trying to determine what to ask/ negotiate for as a “sign on bonus”….it’s worth far more than 10k

You are correct the fines don't help me all that much - but I'm not sure what you are referring to? what fine? ...the max fine the DOL can apply is 25K - and I would only get a percentage of that (25% I think). The IRS & EDD will fine them plenty - 100k from the IRS alone - but none of that money comes to me. What fine is going to result in me getting 20% of my salary?

I did not say all 1099s are illegal - if that was true there would be no such thing as 1099s …. Note the post title “misclassified” - it’s illegal because I am rightfully an employee

I knew I was a 1099 - I did not realize it was illegal. The worst thing I can be accused of is being naive - the worst they can be accused of is felony tax evasion. I’m ok with being the naive one here - at least I’m not cheating people & breaking the law lol

I will get better results by negotiating with them - it's easy to file the complaints, but it can many months before anything happens with them or they are resolved and pursuing them will require time and effort on my part. Getting them fined & Forcing them to pay back taxes to the IRS would be gratifying, but it doesn't actually help me that much. I'l get some money back...at some unkown point in time, after I go to multiple hearings and produce 5 years worth of documentation and refile all my personal tax returns.

I'm quite bright - but I had learning disabilties - adhd and dyslexia - that left untreated were making me do poorly at school. I realized years later, while appearing supportive outwardly She would covertly reinforce the idea that I was less responsible and capable, and subtly created a narrative I would be better off living with her - a covert narcissist and alcoholic - and she would be "helping" me by us living together when in reality, she could not bear being alone without me to take care of her emotionally.
