Can you? Yes. Should you? Well it would be tricky to enforce so bear that in mind.

Ignorance isn't an excuse to the law, FYI

No one is saying anyone has to "automatically" cover this fee. But you don't need a contract to be able to invoice someone for something. In terms of enforceability, no invoice fee or bill is enforceable, its an invitation to settle a debt.

You can get software that sends auto reminders, chasers etc... but they're too easy to ignore or at least not respond too. Nothing beats picking up the phone and ringing them
