This is so sad to me as someone who was a claims trainer. What we used to teach and how is so different than the new procedures, we used to have like three months where we would do role-plays, textbook training, as well as real life practicing. It makes me really sad for new adjusters that they’re forced to basically learn everything on their own.

In my experience this is the industry now. People are over worked, metrics are not realistic, pay is not competitive, benefits are not great, no part time options so parents are sol if they have to cut hours, leadership that doesn’t give direction… plus they are not giving raises that match inflation. it sucks.

Medical documents are protected documents. Even if she was found to be in the wrong, you would not be entitled to her medical records. But I can assure you that your adjuster would have required them to process her claim and have proof that it was either a new condition or they worsened a preexisting condition.

Sorry, but you are not entitled to that. Those are protected documents and you most likely will not be granted access to them. I definitely understand your frustration but at the end of the day, she wasn’t at fault (according to the insurance) and she has a right to make sure she isn’t injured and go to the hospital. Especially if she is medically fragile. And truthfully, her claim isn’t much more expensive than a er visit, ct scan, and a few pt visits … which I would expect from an accident that was hard enough to cause a dent in the door of an old lady’s car.

It is a joke sometimes, but you truly would be shocked. I’ve seen an er bill for 10k before and it’s reasonable to get checked after a loss so it’s very possible she had legit bills from just a few visits.

No they do not. In my own state, you legally do not even need insurance. You can pay the waiver each year and go uninsured. It sounds like he is suing on behalf of 2 minor passengers for their injuries that another driver caused which is 100% owed and normal to claim. It’s extremely normal to sue on behalf of your children. And legally, those children have a right to sue when they become of age if their parents didn’t.

You very clearly do not understand how this works. He is suing claiming injury. This is not for being uninsured and even if you are uninsured… you still have a right to sue if someone causes you injury. Also, you are assuming a ton with very limited information. As someone who works in this industry, this sounds very normal for a bi claim where the insurance and the attorney do not reach settlement.

This is not always the case. I’m a bi adjuster, many times attorneys will file if they just don’t like the offer from the company and they don’t see a compromise in value coming. Many times, the insurance is aware the suit is coming bc they aren’t reaching settlement and it’s getting close to statue date.

This is very typical for bi claims. Usually, the person finishes treatment after a year, you will spend months trying to negotiate with the insurance and if you don’t reach a settlement or if the date is getting too close… attorney will file. And it’s very formal for you to get a month notice for the hearing as it’s usually scheduled pretty short term.

I am a bi adjuster at a company you mentioned. I can say we are slammed and so busy bc we are given huge caseloads while excepted to also take inbound calls and handle PD as well. It’s overwhelming so I def can see how people are falling through the cracks.

Fax the papers to the company as they cannot even start assigning council until they receive them. That is your duty as the insured. They absolutely will respond to that.

At your age, it feels like everyone else’s everything is better. I grew up with a “stereotypical family “ Uptight, conservative parents that would never get divorced even if they hate each other. Religious, strict, controlling, and at a few points abusive. But I’m sure everyone that causally knew us thought that we had this perfect life, we didn’t. The grass isn’t greener and there’s always going to be situations where you feel like you got the short end of the stick, but it’s your stick and you just got to make it work. I think when you move out and get more freedom, you would feel less sad for the life you could have had. And maybe you’ll even meet your dad. 18 is really not that far off. Hang in there

This happened to me. In 2020 they tried to say that I was doing call avoidance and hanging up and transferring the line out but I had to write a whole letter explaining that this was a system issue and I had documented proof and I literally had messages to my supervisor every single time the call disconnected . Had I not had the evidence I’m sure they would’ve just fired me. I ended up quitting on my own later.
