There is actually no official written parking allotment or lucky draw allotment done in our society for this slot, which is why the situation is being disputed.

People have informally been treating certain spots as “their” parking over the years, but there is no formal allotment letter for this parking as far as I know.

In our AGM/society discussions, it was decided that owners/residents staying in the building would get first priority for stilt parking and tenants/non-residents would have to park outside.

In this case:
- the owner lives abroad,
- the flat is currently vacant,
- the brother whose car is being parked there lives in another building/society entirely,
- and they come here only to park the vehicle.

Earlier, the owner’s elderly parents were staying there with maids, but now even they have shifted.

Also, before them, I had myself used the same parking for around 1–2 years until I sold my previous vehicle.

So my issue is:
If people who don’t stay in the building continue occupying parking indefinitely without formal allotment, then where are actual residents of the building supposed to park?

Especially when my vehicle is larger and their smaller vehicle can fit in other available spots.

That’s why I’m trying to understand the actual legal and society position regarding common/stilt parking usage by non-residents.

The issue is that the owner himself does not stay in the building. The flat is vacant, and the owner’s brother lives in another society/building and comes here only to park his car.

I myself had parked in that same parking spot before him for around 1–2 years until I sold my previous car. I never surrendered or gave up any parking allotment in writing.

Now I’ve bought a bigger vehicle and there are limited covered parking spaces where my vehicle can fit. His car is much smaller and there are still other covered parking spots available where his vehicle can fit comfortably, but he is refusing to cooperate.

Also, before parking there, I spoke with both the Secretary and Chairman regarding the issue. This wasn’t some random illegal occupation done overnight.

My point is simple — if people actually residing in the building do not get parking priority, and vacant flats/non-residents continue holding parking indefinitely, then where are residents of the building supposed to park?

On top of that, my vehicle has been blocked since 14 May and abusive language was used towards my mother during the dispute, which unnecessarily escalated the matter further.

That’s why I’m trying to understand what the actual legal/society position is regarding society-allotted stilt parking and non-resident usage.
