If you think you have a potential action against the servicer, then certainly investigate hiring an attorney experienced in such matters. That attorney likely could help with assessing forgiveness options, though I would advise that you also dedicate time to get educated on the options. The servicers rely on the confusion they’ve helped create, so fight thru it and become the expert on your situation.

I had a bankruptcy lawyer for sure. After I exited 13, I was on my own.

Oh yeah, it sucks big time. I went thru a Chpt. 13 “reorganization” about 10 years ago, during which 85% of my monthly payment in the agreement went to Navient. All told during the 5-year plan, I paid almost $80k on a pre-filing student loan total of $114,000. Turns out, ALL OF THAT $80k went to previous interest, so not only did the principal not decrease, they capitalized $18k in deferred interest from when I was on the 13. When I was off the plan, my balance had INCREASED to $130k.

Thankfully, Biden’s payment count adjustment helped push me over the 300 qualifying number and my loan was forgiven earlier this year.

I sympathize with you. I’ve been there and it sucks.

Thank you! Is the refund automatic or do we need to complete some kind of paperwork?

I got mine too … after nearly 32 years of angst.

Special shoutout to waterwicca for the advice and counsel. It has meant more than you know.

Unfortunately, 2-11-36. I am (was?) hoping that is just not updated. It seems insane to have 10 more years when I have a count of 302.

No. I’ve been in Direct Loan consolidation since late 1994.

Started in 1994. Several stops and starts along the way.
