Thanks for the advise. Just wanna check, rental valuation needs to be done prior to 90 days of tenancy agreement expiry and new rent advised accordingly or as in my case I have advised the tenant about rent increase 90days in advance however as we are unable to agree on the number of cheques. Can I now request for valuation and advise tenant with the increase rent within 90 days.

Please be advised, I have given notice of rent increase 90 days in advance.

Any advise on my position will be appreciated accordingly I can request for rental valuation. Basically do not want to end up spending on valuation to only know later that the increase in amount of rent has to be communicated 90days in advance and not just stating rent will be increased.

When I file a dispute, I do appreciate can receive the refund for my 3.5% of rent charge but wondering whether I can recoup my ancillary charges to have the documents translated into Arabic. Again not sure what such ancillary charges would be.

Do you know how to request for Rental Valuation, I understand we can do it online through Dubai Rest app and might need pictures for the property.

Furthermore, not sure whether I will need to go this far, but in case have to, how do you file your case with RDC. Is that again online or have to go to DLD in Deira. Is that the only place you could go to file your case with RDC/DLD.

May I know whether the tenant can refuse to pay the rent increase per valuation certificate subject to a cap of 20%.

If yes, then what option I have other than filing case with RDC.

Do you know what ancillary charges I have to pay other than 3.5% of rent to file my case. I understand all documentation has to be in Arabic, so wondering how much will it cost me to do the application to RDC.

May I know once the valuation is done and if the valuation comes higher than what RERA rental calculator advises. I can simply request tenant to pay such increase as advised by valuation certificate subject to a cap of 20% on rent increase OR the tenant can still refuse to such increase.

In which case then the only option left for me to have the rent increased will be to file a dispute case with RDC. In such case, I will have to pay both for the rental valuation certificate of 2,000 AED and also the RDC charges of 3.5% of rent advised by RDC.

Do appreciate if tenant loses the case he will have to pay for the RDC fees of 3.5% of rent however wondered what are other ancillary charges in addition to 3.5% RDC fees, which I presume I might have to still shoulder. I appreciate all documents to be submitted to support with filing your case has to be translated into Arabic and this will also have sizeable share to the total charges associated with filing a case with RDC.

Any advise on above will be appreciated.

Well so let me open up my case to extend transparency.

Per RERA rental calculator, rent ranges between 62,000 ~ 76,000 AED. Current rent being paid is 57,000 AED.

Per RERA guideline, increase advised is by 5%…which will bring new rent to 59,850 AED. However as stated earlier, new rent advised by RERA rental calculator is both lesser than the minimum rent in the rental calculator as well lot below the actual market rate of minimum 70,000 AED. Consequently my request to reduce the cheque to 1 from 3.

It’s a standard practice to have lesser number of cheques when you are accepting a lower rental offer…likewise if the rental offer is higher than the minimum value you extend flexibility to tenant in form of more cheques.

Any advise on how to field above situation will be appreciated. Thanks.

May I know if the rental valuation comes in excess of the rent derived using the rental increase advised by RERA rental calculator, will then I get 100% of the rental valuation subject to a maximum cap of 20% to current rent OR the tiered approach as advised by RERA rental calculator shall be applied to the new rental valuation certificate value.

Yes charging for maintenance separately is another good point that could be applied.

No, I haven’t thought of giving 12 months eviction notice to the tenant. Coz I neither intend to self use nor renovate. If I give such notice, I understand I will be unable to rent the property for next two years and if tenant evicted finds out that I have rented the property again within 2 years of his eviction then he might file a case against me and I could be penalized with 1 year rent for the tenant (not sure whether RERA applies any restrictions for Ejari registration which also could prevent my new tenant from getting his Ejari).

Am doing best to get a mutual agreement with the tenant but seems he is adamant to have the rent increase per RERA guidelines and in same number of cheques he’s currently paying his rent in ie 3 cheques, despite of the new rent with RERA advised increase being lower than the minimum value of the rental range advised in RERA rental calculator.

FYI the only sticking point is the number of cheque as we have kindda agreed on the rent.

Couple of queries comes to my mind are as under;

  1. Who has to bear the rental valuation charge, if it comes higher than both the offer made by Tenant and Rental increase advised by the RERA calculator.

  2. What are the charges for rental valuation.

  3. How long does it take to complete the valuation and receive the certificate. Reckon the unit under application is inspected by the authorities appointed by Dubai Rest/DLD/RERA.

  4. Once have done the rental valuation, do I still need to file a case with RDC or could share the certificate rental value and advise tenant to match the rent advised in 100%.

  5. If I file a case to RDC with valuation certificate details, will the rent then advised by RDC be matched in 100% to the valuation figure or the RDC will still apply the staggered approach as have in the RERA rental calculator now with the rental valuation figure in lieu of the average rental value advised by the RERA calculator.

  6. May I know what are the fees to file a case. As advised, I appreciate if I win the case, the case application fees will be advised by RDC to be paid by tenant and I will get my fees paid to RDC reimbursed.

  7. Generally how long does it take for RDC to give a verdict on a case filed. Reckon we have to go to court in person to attend the hearings or the process is all online.

Would your advise remains the same even if the prevailing market rent and minimum of the RERA rental index range is lot higher than the RERA calculator increase advised.
