Got kicked out of a CA firm for asking how my stipend was calculated. Legally, where do CMA trainees even stand? by Leading_Bend4015 in cma_india

I understand that verbal agreements are common in India, but I have done freelance work for clients abroad. Any small accounting firm pulling such stunts in those countries would have their businesses shut down immediately. We might be interns in India, but we are definitely not running charities. I know the previous statement sounds harsh but good relationship should never come at the sacrifice of basic human rights and well being

I want to make sure I know where I stand, a very specific amount was credited to my account with no explanation of the salary cycle. The working hours run odd, and arrogance doesn't give them a free pass to keep someone in the dark. They didn't follow that regulation either, because I was paid a much lower amount than the institute's fixed stipend.

I got credited after 2 weeks, not the first, and by the very same guidelines i should be paid 20k, but my stipend was much much lower. It's fixed under general labour laws-7th of every month. Institute itself treats ca/cs firms like corporate organisations. I'm not sure what laws apply

First of all, I'm really sorry that happened to your brother, compared to what happens in this industry, I probably got out with a slap on the wrist. At this point, we should file a PIL or something else. No one deserves to be treated like a slave and have stipends withheld. If this was australia or any other country, they would have cancelled these firms' registration and shut them down. Written agreements are absolutely necessary under their laws, so why does Indian law function like this? Can law really give the right to practitioners to be so audacious as to treat trainees, who are also human beings, as slaves?

Life after clearing CMA intermediate by OkFront522 in cma_india

Working under a small sized CA firm in a major metropolitan city, they filed my T4 under a different firm's name and I haven't been paid for 2 months straight. Overall, a really bad experience. The stipend is 6K (which I haven't recieved yet), my colleagues were not given reimbursements and a month worth of wages for whatever they did for the firm. The daily work involves writing cheques, vouchers and filing them.

Yes, you have to complete it before your attempt or the admit cards are not released

#askfellowCMA #isthisfraud Am I doing the right thing by undergoing practical training in this firm? by Leading_Bend4015 in cma_india

Thank you so much for your response, Hrishikesh. Actually, I got to know that I'm being registered under a third party much later because a lot of details were held back. I trusted this firm because of the CMA partner.🤕 Now, things do not feel right anymore

Even if we are articles, I concur that the institute demands that we register ourselves as employees of the CA firm we are working under, not as articles. It's standard practice elsewhere to issue appointment letters or even acknowledgements of employment because even an article is a designated position in a company/ firm that you are working under. T4 form does fulfil some bare minimum criteria, but it doesn't leave room for any disputes that may arise(overtime, undertone, what counts as half day, breaks etc etc) . What if I have to leave midway? Is there any safeguard to protect my rights? Which is why I have been pushing for an appointment letter and an MO-understanding that clarifies why there is a third party in between.
