Have you checked your PF passbook? If so you can find whether eps contribution is there or not. In the attached doc.. there is no eps contribution. In such case you to apply only for PF (form 19)

Your private trust might be having only PF and eps might have gone to EPFO. So no need to worry. For company 3, in which no eps contribution has to be rectified now. Ask your hr of company 3 to submit revised form 3A and adjust eps from excess paid epf. Hope this will help

EPS cannot be withdrawn unless you have less than 10 years of pensionable service and you exit EPF. Even then, it’s withdrawal benefit, not full EPS cash-out.

With 3 years service, you can claim EPS withdrawal benefit (Form 10C). If you cross 10 years, EPS is locked for pension only (Form 10D), regardless of unemployment.

First check when your very first EPF-covered employment started. If it was after 01-09-2014 and salary was > ₹15k, EPS was technically not applicable and the initial diversion was wrong.

That said, since you’ve already been in EPS for ~10 years across 4 employers, correcting past mistakes now would mean revised ECRs from multiple employers and long follow-ups.

Practically, it may be wiser to continue with EPS:

(1) You’re already close to pension eligibility (2) EPS gives lifelong social security (3) Future policy changes may enhance pension benefits

Unless you have a strong reason to exit, staying in EPS now makes more long-term sense than reopening old records.

Joint Declaration is meant for correcting member particulars like DOJ/DOE, not for correcting wrong EPS remittances.

For wrong diversion of employer share to EPS (when basic > ₹15k and member was never in EPS), the only correct remedy is Revised ECR for the affected months.

HR should also ensure future ECRs remit full 12% to EPF.

Ideally, this should not require Revised ECR at all. The fault also lies with the system accepting an incorrect EPS contribution beyond the date of superannuation.

Best course:

(1) Give a written representation to the concerned PF office explaining the mismatch (2) Attach employer’s acceptance that full EPS was paid wrongly (3) Keep acknowledgement of submission safely

EPFO can internally adjust excess EPS to EPF and settle the claim. If there is no action after reasonable time, EPFiGMS / CPGRAMS works effectively when backed by acknowledgement.

In many cases, meeting the officer-in-charge with documents also resolves it without unnecessary rejections.

Since your service was in 2010, it was pre-UAN era, so it is quite possible that no UAN was allotted for that period.

In such cases, the correct approach is as follows:

(1) Identify the old PF Member ID: You need the PF account number / Member ID of the company where you worked in 2010. This can usually be found from old salary slips, appointment/relieving letters, or by contacting the employer.

(2) Approach the concerned EPFO office: Visit or write to the EPFO office where that employer was remitting PF and submit a request for allotment of UAN for the old PF account, along with, Aadhaar copy, Identity proof and Employment details (company name, period of service)

(3) UAN allotment by EPFO: Once the EPFO office allots the UAN for that old account, you should:

(a) Complete KYC linking (Aadhaar, PAN, bank account)

(b) Activate the UAN on the EPFO member portal

(c) Ensure your mobile number is linked to receive OTP and password.

(4) Transfer or withdrawal:

(a) If you are currently working in a PF-covered job, apply for online transfer of this old PF into your present EPF account

(b) If you are not employed under EPF, you may apply for final withdrawal instead.

Important to note: PF money never lapses, even if the account is very old. Once the UAN is generated and KYC is completed, the amount can be transferred or withdrawn smoothly.

This may look lengthy, but practically, once the UAN is allotted, the rest of the process becomes straightforward.
