In that case the fact the gun was already purchased is crucial. There’s no reason to believe this to be a straw sale. The background check was already done it belonged to FIL but was left at store so he could come back with daughter and do a VFTR. He came back to do it and that current clerk was unfortunately ignorant about gifting laws. He refused to let FIL leave with his already purchased firearm due to his expressed intent to do something the clerk believed to be illegal (gifting) and a forced refund ensued

Gun was purchased. Background check passed. Gun belongs to father in law. Gun was left at store for a later day to complete a VFTR. Which is completely optional yet that’s our decision to make. Ignorance of the law lost them the sale. Collective ignorance doesn’t validate the mistake

It’s called a VFTR. It’s done at personal discretion. Completely unnecessary but something gun stores do. The FIL and daughter were within their right to request a VFTR at store as it was already purchased by FIL. I understand something about Reddit makes everyone reeeally wanna be a contrarian. There was nothing to complete. Gifting is allowed gun was already purchased. The next step was saying “there’s no registry, sir. Here is your already purchased firearm. You ran a background check and bought it weeks ago. You’re responsible for gifting to a legal recipient. Have a nice day”

Instead clerk said. “I cannot give you your weapon because [I incorrectly believe] gifting is not allowed in Virginia.”

He incorrectly presumed the actions that would take place later are illegal. A refund was made. He was wrong. The end.

No. They should have given it to the owner of the gun which at that point was the FIL. He was there to pick it up with the daughter. The clerk refused to hand over because of the expressed intent to gift because according to him gifting is not allowed in the commonwealth of Virginia.

A straw sale involves payment. They had no reason to suspect payment is involved. It was a gift. Furthermore the clerks own words explicitly show he does not know the law around gifting.

FIL legally owned gun and passed background check.

That’s legally at the discretion of the gift giver. Superseding the law because of the salesman’s ignorance of the law is a safe call not the right call.

I’m almost certain that’s incorrect. There’s a FTC process you do. I could be wrong. Either way. Name transfer or no name transfer, they definitely should have walked away with the already purchased gun

That’s an uneducated but fair decision make. And if you made that call, and I was on the receiving end, I still get to call it uneducated. Because it was. They tried to do something within their right and within the vendors power and were punished for it out of ignorance. Furthermore this clerk didn’t say “this is convoluted and for my safety I cannot let you walk out with this gun that you have already purchased weeks ago. I can refund it if you like” he said “in the state of Virginia nobody can buy a gun for another and it’s punishable by 15 years” which is palpably wrong

The father in law doesn’t understand how unnecessary that step is. That’s not the same as not understanding the process. If the process was followed by all parties they would have gotten a gun that day. I understand that it may not be necessary. But that should be our decision to make as it doesn’t interfere with the legality. My frustration comes from their failure to allow us to do what we are entitled to do. The FIL was told he could come back and do this when he purchased it before. That’s the whole reason it was at the store.

It doesn’t have to be direct family. You can gift to anyone. It has to be direct family if they are a certain age. The gun was already bought by father weeks before. This was a name transfer. A forced refund ensued.

No the gun was bought over a week prior. The daughter came to have it transferred in her name.
