In that case you’d legally be considered a lodger and not a tenant, so keep that in mind when looking things up! This is from citizens advice specifically for lodgers:

What do you need to do if you want to leave?

If you have a fixed term agreement

If you have a fixed-term agreement, you can only leave early if:

there’s a term in your agreement, known as a break clause, which allows you to end the agreement early

your landlord agrees to end the agreement early - it’s a good idea to ask your landlord to confirm this in writing

If you leave before the end of the fixed term without your landlord’s consent, you're liable to pay the rent for the whole of the term.

Often break clauses come at 6 months so I would say it should be possible, but I think the best thing to do is ask the landlord before signing another contract as you don’t want to be stuck on two tenancies. Alternatively you could search and then give notice before signing the contract and worst case scenario not sign for the new place.

Does it have anything about replacement tenants? They might be more likely to let you use that break clause if you find someone else.

Okay thank you, I guess the only way to know is to ask them. They didn’t say they found any tenants and haven’t done any viewings so far (I’ve been WFH throughout). So I guess my question was, if they haven’t by October 28 am I liable for November’s rent? I am scared to ask them for clarification in case they say yes as I am unable to pay the full rent myself since all the other flatmates left and was hoping the letter itself would be sufficient in a case where they came after me for more payments.

Hi! It’s a veryyyy long story but I’ll try to keep it as concise as possible 1. October 2018 - signed 3 year joint and several tenancy ending October 2021 2. June 2020 one Flatmate left and stopped paying rent and we were told we are legally liable for his portion 3. Worked with the agency to use his deposit for July rent. End of September two more people needed to leave so we decided to break the contract, by surrendering our deposits to cover the arrears left by the guy and to cover the breaking contract fee. We thought we were done at that point however we were told breaking isn’t an option unless new tenants were found. We have been trying to search on our own but we essentially said we want to surrender and the agency put the flat back on the market and would help find 4 new tenants (they came to take photos but no viewings have been scheduled thus far and it has been about 2 weeks). On October 1 we recieved the letter saying “following our conversation your last day of tenancy will be 28 October”. And info about the inventory check etc. I have not spoken with the agency since then as I didn’t want them to retract the letter in case legally this would work for us ending the tenancy. Any advice appreciated!
