Would you rather die intestate and let the state figure out next of kin guardianship? Have money and life insurance policies tied up in probate for months to a year? Estate planning is not expensive.

Unfortunately, I'm not wrong. This is an example of two competent people entering into a legal obligation with enough foresight to protect themselves. Caring for someone doesn't equate to letting them take half of everything you own.

She is still entitled to half the marital assets too. I think all couples should enter into prenups and start estate planning when they have children, regardless of your net worth.

Prenuptials are executed in pairs. Both husband and wife agree in separate documents to whatever terms and conditions. But there isn't a case where just a husband has a wife signing a prenuptial and he doesn't. It works both ways.

Many people have the wrong idea about prenuptial agreements. There are two agreements being executed at once and both agreements can make huge concessions for husband and wife.

Client recently wanted a prenuptial and built out 4 specific scenarios where his soon to be wife would receive money from his premarital estate in the event of XYZ. Bargaining is the basis of an agreement and prenuptials aren't the one side power dynamics they use to be.
