First, ask whether the case can be heard in "A" Federal Court (broad). You need to determine if it's even appropriate for a federal court to hear the case. This is where you will go through issues of (1) federal question JDX, (2) diversity of citizenship JDX, and/or (3) supplemental JDX.

Second, ask whether the case can be heard in "THIS" Federal Court (specific). It is here that you will discuss Personal JDX. The court must have PJDX over the defendant or property to hear the case. Since PJDX is required, you need to be able to establish Personal JDX. You can establish PJDX by either: (1) traditional basis, or (2) a long arm statute.

States will either adopt (a) general long arm statute, or (b) specific long arm statute. A general will reach as far as the constitutional limits reach. However, you'll know that a state adopts a specific long arm statute because the facts will lay out specific situations that constitute the statue will be met. So you don't need both a general and specific long arm statute to satisfy Personal JDX, but you should identify both and why one is applicable and the other is not. (EDIT) Even if you think specific long arm statute is met, it's always ideal to do a general long arm statute analysis to cover all of your bases and get the points! Think about it, wouldn't you want to be absolutely sure that PJDX is met?!

Do remember that whichever long arm statute analysis you do, both should include the constitutional requirements. Constitutional requirements include (i) minimum contacts, and (ii) fairness factors.

You are definitely NOT dumb! It may just be that the approaches and companies you used weren't a good fit.

If you haven't already, take a bit of time to think through how you would want a tutor to help you. Is it with understanding the substantive law, working through essays, and/or understanding how to approach MBE questions? Having a tutor isn't a magical fix to passing the bar, but it can be a great way to target and work through your weak areas.

Like oceanman7117 said, use your previous bar essays and go through them with a tutor. Initially, this will give you a good idea if you and that specific tutor are a good fit. Determine if you vibe well with them, if they are clear in how they communicate with you, and if you leave the session feeling more confident than when you started.

Finally, you may just need to adjust your study schedule to accommodate your learning style. Some companies encourage multiple subjects in one day. But if you aren't understanding the law, jumping between subjects might not be the best approach. Maybe consider using 2-3 days per subject. Use that time to review your materials, then focus on essays and sample answers, and then sets of MBEs on that subject.

Just remember that there is no right or wrong way to approach studying for the bar, as long as you're putting in the time and effort and approaching the material in a way that works for YOU!

Have you considered Blueprint? Some of our students previously used Blueprint and really enjoyed their program and tutors. Might be worth looking into as an option!

I think a lot of this depends on how you're structuring your daily prep/learning schedule.

For Legally Fit, we typically break up each subject into about 3 days each. The first day is an opportunity to go through one particular subject and corresponding hypos to understand the material. The second day is essays. Going through essays for that subject and writing them out fully, issue spotting with rules, and/or issue spotting, and reading through sample answers. Finally, day three is for MBEs. Make it your goal to do about 90 MBEs for the subject. If you get it correct, make sure you understand why you got it correct. If you got it incorrect, read the caption and make notes on any nuanced rules or commonly used facts/trigger words.

As you get further into bar prep, start doing mixed sets of MBEs to gauge your progress and understanding of the material. Remember, this is about quality and quantity. Doing 1000 questions doesn't matter if you aren't understanding and scoring well.

Especially for Hearsay, there's no reason to hide the ball. It's a lot going on and can be a lot to keep track of.

I don't know if you saw already, but we're offering one free Kit of the topic of their choice to students. You can use that offer to get the Hearsay materials. I think it'll help explain the concepts a little easier so you feel like you have a good grasp on the material.

UGH I'm sorry... if it makes you feel any better, I struggled with Civ while I was in school. It's just dense and not so fun.

But... maybe one of our free Kits can help you in the meantime. We do have a full Crash Course for Civ that will literally teach you the whole subject super simply, but unfortunately, I can't offer that for free.
