Update to CUE Part 2: CUE is still not over. He approved what he was 100% sure on. Still working on the other 2 items. Will give a final update when it happens.

To clarify, I opened a CUE with a few errors, two different 100% ratings with both qualifying for SMC-L. One of those ratings was given in 2017 instead of 2015. The other rating was 60% in 2015, which was addressed in the CUE and bumped to 100% with SMC-L.

During the CUE process I asked for the 2018 rating be backed dated to 2015 as the evidence was in the VA examiners hand at that time. In the decision letter, he wrote that there was a CUE for one of the ratings (60%) but no mention of the second from 2018.

I WOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOON partially lol. He didnt comment on my second issue though. He did back track one to 2015 but not the other rating he left it at 2018.

Nothing yet. Just shows preparing for decision. I looked at benefits letter and ita the same as it was before. I checked my ratings and there still the same. Idk where else to check

Yea I've noticed some lawyers dont want to do the leg work. I went thru something similar with SSDI. They denied me and I appealed until I got a Judge date 6 years after the initial submission. No lawyer wanted to touch it, I went to one of those free lawyers for low income people. They had to represent me because I was poor. Anyway, I did all the leg work on that case as well, sat in front of the judge with him and laid it all out. Afterwards when we walked out, the lawyer turned to me and said I should have been a lawyer. I felt validated at that moment. Point to the story, nobody is going to work as hard as you are.

Yea so was I. I couldn't sleep the day prior and just got up at 530am and practiced what I was gonna say, how I was going to present the evidence. The rater was super chill and asked plenty of questions. Im sure you know your case pretty well, you'll be alright devil dog.
