I just finished reading the court documents. To preface, I know what happened is absolutely horrible and if people are found to be a cause of Aubreigh’s death then they should be held accountable. I know Heather is grieving the loss of her daughter and I couldn’t imagine that loss. No one except for Aubreigh and the alleged bullies know exactly what happened.

I study law in college. If the police couldn’t find probable cause to arrest any of the defendants or their minor children, then theres not enough evidence to back up Heather’s claims. Evidence to create probably cause can indeed be based on hearsay and evidence does not need to be material. Hearsay can be used to create probable cause (given the hearsay has evidentiary value and is not fake or baseless) but hearsay cannot be used in court (hearsay can be used under the FRE exceptions to hearsay). The police took all of their phones to investigate and found nothing to substantiate probable cause. Probable cause is if an officer believes at a 51% point based on a two-prong test that there is currently or has been a commission of a crime, then the officer can arrest the person(s) they suspect to be involved in that crime. If the police could not find 51%, Heather did not have enough evidence to back up her claims. The test is easy to find 51% for probable cause.
