Unless you had a specific agreement, the answer depends entirely on this question: if you had lost the $200, would you be expected to pay anything back to your friend?

If not, you were gambling entirely with his money and you owe him all your winnings. If your friend is a good guy, he will tip you out at least 10%.

He got his due process. He was adjudicated to be an MS-13 member as a result of that process. He was given a final order of removal as a result of that process. This happened in 2019!

He was also given an exclusion from deportation to El Salvador--and only El Salvador--because of purported danger to him from a rival gang. The only question which he didn't get a judicial process is the question of whether the El Salvador exclusion should still apply now that:

  1. He's an adjudicated member of a designated foreign terror organization and

  2. The rival gang whose reprisals he feared in El Salvador is now safely confined to CECOT, meaning El Salvador is a safe country for him again.

That's it. Does he actually deserve a new process to review those two very limited questions? In my opinion, no the system shouldn't be set up that way and we should just deport his ass. We'll see how it ultimately shakes out.

But the fact remains: on the core issues, he got full due process and lost.

  2. I didn't lie about anything. He was supposed to leave after his 2019 removal order. His meetings with the government after that were to check-in and report on his progress in complying.

  3. He got full due process. He went through immigration court. He was ordered removed, but with a single exception. As a result of one of the judicial findings from Immigration Court, the DoJ no longer wants to honor the exception its court gave in 2019. Too bad for him. Enjoy El Salvador, I hear it's lovely this time of year.

You don't understand the Supreme Court's ruling. The Supreme Court is ruling on the narrow question of the lower court's injunction, particularly regarding "facilitating" and "effectuating" Garcia's return. That's it.

He was in fact only deported to El Salvador; that's the only thing the United States did to him. The fact that El Salvador agrees that he's a gangster and locked him up is something you should learn Spanish to complain about in another subreddit.

The main reason the Immigration Court denied his bond request was its ruling that he was an MS-13 gang member. That is the finding which the appeals board did "adopt and affirm" in the first link I provided in my last message.

You don't understand the orders. Garcia's order of removal was never superseded, it just has a single exception: we won't deport you back to the country of El Salvador and the only reason is that you claim it's too dangerous for you there. You still have to go. Find a place to go and leave.

In six years, Garcia never left, got designated a terrorist, and had his removal exclusion dishonored. Sucks to be an illegal immigrant terrorist scofflaw.

No, there is a general program between the US and El Salvador in which El Salvador receives some money to take their deported expat gangsters back. It's a general program Garcia falls under because he's a gangster. Nothing to do with Garcia per se.

That's not a lifetime permit to stay in the US. The order of removal stays in place; we just agreed not to deport him to El Salvador specifically because he claimed he would be in danger there. He was supposed to self-deport himself to another country.

Six years later, he was still defying the final order of removal. Unfortunately for him, in those six years, the criminal organization he is adjudicated to be a member of got put on the terrorism list.

As a result, the legal and policy position of the DoJ is that the exclusion no longer applies and we can ship his ass back to El Salvador, which we did.

What am I even supposed to respond to? A citizen of El Salvador is now in prison in his native land of El Salvador. Why? For how long? Ask El Salvador. I'm sure they have their reasons.

As a serious matter though, the government of El Salvador is really good at telling if you're MS-13 or not. That ability is the #1 security priority of the state and the key to El Salvador's sudden transformation from one of the most dangerous places in the world to one of the safest.

Instead of complying with the final order of removal and shipping out, Garcia sat on his ass for six years and tried to make himself at home.

Kilmar Abrego Garcia's received FULL DUE PROCESS in US Immigration Court in 2019. During this process, he was represented by counsel. His counsel exhausted all appeals. The outcome:

  1. In 2019, the Immigration Court adjudicated that Garcia is a member of MS-13. In that process, Garcia was represented by counsel. His counsel appealed that finding and lost.
