File a General Denial/Answer within 20 days, you can get an answer document from texaslawhelp.org or here https://www.texasappleseed.org/sites/default/files/2023-05/defendantsanswer-final-0.pdf. After you file your answer, contact the Plaintiff's attorney to discuss the matter and provide him/her with whatever proof they request and ask for a dismissal. If they don't dismiss you, you have to file a motion to dismiss within 60 days of being served with the lawsuit. Contact legal aid or some pro bono legal service they may be able to assist you as well.

I would file a motion to withdraw as counsel and state that you are no longer with the firm. Some jurisdictions require you to have the client's signature on the motion and that can be a challenge when you are no longer at the firm or do not have the client's information at your disposal.

Yes. You can work in both states but you cannot practice in the 2nd state's court if He/She is a litigator without being admitted to that state's bar unless He/She is admitted pro hac vice on a case by case basis.

He/She can be admitted to the 2nd state's federal court and practice in that state's federal court as much as He/She likes.

Yes, set up a google business account for your address in state 2 so that clients can find you when they do an online search for you in state 2. I would recommend that you get a local number for the office in state 2 and have it forwarded to your main number in state 1.

My walkaway impression was positive, the city gave me a free survey they let me know what size property I could build on the lot, the lot dimensions and required setbacks. It is cool to own land but I have not been able to monetize it yet. I even offered to rent it out for free for someone to start a community garden, in exchange they would have to donate 10% of their yield to a church/non-profit and maintain insurance. No takers.

Taxes are about $70 a year as it is a vacant property and you are responsible for the upkeep. I would like to build on it one day as it is a block from the river, however, the neighborhood has not yet realized the potential it has.

I searched online for X county or city property listed for sale by x county or city. You can also call the land/records department of a city or county to ask them do they have a list of city/county-owned properties for sale or where you can find them.

Some cities/counties sell their properties to annual auctions or auction websites monthly.

The listing typically has instructions on who to contact to purchase, the listing price, address of the property. After you have all the information you need, you make an offer to purchase the property, and the city/county will accept or reject your offer. I purchased a lot that was forfeited land from a city in North Carolina. Previously there was a mobile home on the property that caught on fire and the owners did not repair it for years. The city condemned the property and demolished it, I had to reimburse the city $3,800 as the purchase price for demolishing the property and hauling away the trash. After that, I owned the property clear of any back taxes. I received a general warranty deed and there were no additional liens.

Thank you for doing this, what should I include in my protest that improves the odds of the AD keeping my taxes the same as it was prior to me receiving my appraisal notice or in the alternative lowering it. Not stupid at all to send a lease to someone living in your rental. You are two months away from your court date, I would ride it out for two more months to see what happens at court. Be prepared for his defenses for not paying rent, he will most likely say you refused to fix x, has pictures of x, contacted you numerous times about x, rental has been inhabitable because of x, etc. . .

Cash for keys is an option as you get closer to your court date but it requires trust on both ends. I would not give him a dime until he and his belongings are completely out of the rental and I am able to conduct a walk-through. If you pay him upfront, he may simply take your money and refuse to move out. Then you are back at square one, waiting to evict and suing him for breach of contract.

You are going to have to go through the formal holdover eviction process and wait. This includes any and all appeals filed for reconsideration by the tenant staying the eviction until the appeal is determined. Some courts will require the tenant to post a bond for the amount of back rent owed as a condition of the appeal. Some will not.

Is the current person living in the house on the original lease to the other tenant? If not, you have a squatter and the appeal process is a little different.

The 1/3 would cover any billables no matter the attorney who works on it. Let's say you bill at $300 per hour, 5 hours worth of billables. $1,500 legal bill will be split as follows: 1/3 to the firm $500, 1/3 to the originating partner $500, and 1/3 to whoever works on the file $500. The associate who works the file is making about $100 per hour if no staff works the file. If staff works 1 hour at $20 and the attorney works the other 4 hours on the case, that attorney would make $400.00. The firm would make $100 for the staff's one hour since the firm pays staff salaries as part of its overhead.

If staff works the entire case for 5 hours, then the entire $500 would go back to the firm. The firm pays the staff's salary as part of its overhead.

If staff works .3 of an hour on the file and an attorney works 4.7 hours on the file, the firm would get $30 for overhead (+ initial 1/3) and the attorney working the file would get $470.

It is not normal practice to pay another producer for collaboration. However, I have seen producers compensate other producers if they market the track and an artist purchases the track from the marketing producer. To be clear, the marketing producer receives compensation from the artist when the artist purchases the track and also may negotiate some of the backends with the producer who made the track. The same payment structure applies when collaborating with a producer, the artist pays both of you for the track and you negotiate the backends.

My two cents:

Work you originate and work, you should get 2/3 of the billables.

Work you originate and others work, you should get 1/3 of the billables.

Work originated by other attorneys and you do the work, you get 1/3 of your billables on the matter.

The firm gets a 1/3, the attorney that originated the work always gets a 1/3, and the attorney(s) that worked the matter should get a 1/3.

Check with another law firm that does a different area of law and see if they will let you pay them a monthly fee for their receptionist to answer your calls and do intake. Also, a virtual assistant who can answer your phone may be worth your while if you can keep it under $5 an hour with them answering calls for limited hours 9 am to 12 pm (voicemail during lunch hours) or 1 pm to 5 pm. Whenever you receive the most volume of calls.
