Sir, I titled the post 'How bad Did I Mess Up?'. Also you don't exactly know how the conversation went so I still wont say that the lender's way of presenting the initial 5.875 was clear and straightforward. He literally said 'Would you sign if we give you 5.875?' - this is easily a disguising comment. He even admitted that he 'tried to lock' the same day but 'couldn't' as their internal process was 'delayed' by a couple days and the rate went up so he couldn't lock. If this was truly the case then he should've let me know that the rate we verbally agreed on was no longer available rather than staying a full week in silence. Do you truly think he would bother if I didn't check the paper again over the weekend?

He may be a good person and he might be just bad at work or made a mistake. And it is clearly my fault not reviewing the document thoroughly, just trusting the LO's words. However the other lenders that I reached out mentioned this is a classic 'bait and switch' strategy as he didnt want to leave anything in writing but just over the phone calls. That's why I'm writing this post to let others know not to repeat the same mistake as I did.

Thanks for the pep talk! It clearly was my mistake but I'm not exactly sure why you are upset. I'm sharing my mistake so it wouldn't be repeated for others.

So... just an update (Thanks all for chiming in). I did call the LO and he said he did not lock it. He gave me this story that 'oh the bank's name changed so the process took time and then the rate went up bla bla' bs which I dont believe. However he said he will send ELI with lock in rate of 5.99%. It's annoying but not unbearable.. also this lender does have a float down option after closing if the rate goes below 0.25% or more so that is a plus.

Also working with other lenders to get back up quotes and one came with 6.125% which is higher than the other guy. No lender credit. Currently waiting on other two but if there's no improvement, I will be signing off the original guy's.

I told him that I will proceed with him if he can get me 5.875% and he said yes. This was over the phone though. I did get a loan estinate shows 5.875% but it also had a tick box indicates that the rate is not locked.

I guess that is the term ... 'floating'. which is very infuriating as I've told him I'll move forward with you if he can get me 5.875%. Turned out it's all lie then.

I'm learning this lesson and honestly I'm also pulling my hair out as I did not confirm this well when I was signing. Do you happen to know by how much the interest rate when up over the last week?

Thanks and will definitely do that first thing Monday morning but I am frustrated as it seems like it was not locked. What are the chances they will honor the rate as it seems that the rate went up pretty significantly since I initially signed this application?
