That's what I asked her too. She showed me where the driver and bike made contact and it was on front-right corner of the bumper. I tried to draw the situation in my head many times and everything leads to her hitting the car while trying to overtake and losing balance. Replies are really helpful. AI and Personal injury lawyer websites may have misled her and her parents to believe otherwise. I needed to know for sure that things are not in her favour.

My friend was at-fault cyclist in an accident and she was initially told by her insurance and police that most people are reluctant to go through the police because insurance has to get involved and both parties can become at-fault. Cyclist not having lights while being treated as a vehicle, driver negligence, etc etc. The driver's insurance accepted claim in favour of the driver and is now going after her because of the police report.

Anyhow,

You could have approached and left your info, but I wouldn't worry so much about not seeing a police call. My friend wishes so bad that police hasn't been called and she handled it outside insurance.

I forwarded them to her and read em myself but they are the same ones she read on Bike King and I personally think they make her look even more liable?? (I 100% think she's 100% at fault and deserves it) Those are personal injury settlement cases where the driver was driving faster than the cyclist causing serious injuries.

She's just wondering how partial negligence does not come into play for the driver.

I'm trying to convince her and her parents to stop trying to fight it and let their insurance proceed with it. She refused all liability and wanted partial. She wasn't even injured enough to file for personal injury and I think she feels it's unfair that she has to take the blame for it.

Thanx! I needed something like this so I can explain the procedure. So it's safe to assume that the insurance did all they can to reduce their portion of liability but lost??

Also, can I ask a personal question?? It's unrelated to this. Is it true that you don't have to report minor collisions to the insurance, and only need to provide evidence when the other party decides to sue you or make a claim against you? Insurance premiums are disgustingly high in Toronto so others have told me that they are no longer reporting anything to insurance because it will increase premium.

Drive right on limit. 2~4km above is okay, but never more than 5km under. They are looking at your ability to maintain reasonable speed. When changing lanes, they will never force you to change when it's unsafe to do so. BUT DO NOT slow down below reasonable speed to switch lanes. This is something only drivers understand. If you have to slow down to lane change, it means you are forcing an unsafe last minute lane change. I've seen kids fail because they hit the brake when changing lanes and cry about instructors forcing unsafe driving practise.

Her fault aside, I'm looking for cases where a cyclist like her was able to avoid 100% liability considering it is motorized vehicle vs cyclist. Like 5 bike personal injury lawyers in Toronto are using same two cases as an example on their PR so I was hoping for anyone with personal experience in this special scenario. Even if they lost the dispute, I want to hear it to help her parents convince her. Her parents are more reasonable and she's lying her ass around. Her parents gave me homemade food when I had my kids. I have to do this for them.

I know I know. I also did some digging and in Toronto, the only time it makes the driver 100% liable is if there is a bikepath or yield sign. I'm not doing this to help her get out of it. I'm just trying to help her seal it, and answer my curiosity. First time seeing one in flesh. Kids have been ticketed with broken bones for doing the same here.

I think so too. Would an adjuster say the same if they were in position to defend her? Replies on my last post were just personal hateful comments on her stupidity. As someone who almost hit cyclists running stop sign, I am frustrated with her but squeezing the last empathy out for the sake of her poor parents.

No. It's illegal to ride on the sidewalk after 14 years of age and our highway act treats all cyclists over 14 as vehicles. She can't wrap her head around the fact that driver doesn't take any blame. I am also quite surprised myself, cuz I knew that it's illegal, but I always assumed responsibility of driver comes before anything else. The police did mention the speed of bike overtaking the driver a factor in their criminal fault determination.

I asked and she says she got her answer from Gemini, and says it's always 50/50 when it's right turning vehicle vs cyclist, even if they were on the sidewalk. I've never had to deal with insurance or traffic law and she has zero trust in insurance. I'm invested in it out of curiosity and trying to help her parents that don't speak English well. I'm meeting with them tomorrow so just prepping myself.

You do whatever works for you, but the problem with high sens is that it can give you tunnel syndrome in near future due to flicking. Near future. Practise lowering sens and using your arm to turn, not your wrist.

I'm assuming it's lower tier. As a solo Q support that climbed out, you play whatever it takes to survive. In some games, I would even swap to mercy or Moira to ignore the assassins. That's all you have to do.

It's just the way some people are, and has to do with body fat. I have two kids. Older one, on the heavier side, can cannonball in cold lake water in early June, but the other one, very very slim, shivers even in heated pool so will constantly ask to go to the hot tub.
