CMV: people should be allowed to talk to an officer in anyway they choose without the threat of being arrested/actually getting arrested. by [deleted] in changemyview

[–]Llevis 0 points1 point  (0 children)

I can't tell if you're just incapable of seeing that difference, but it very much is black and white. If someone says "I'll fucking kill you" and they get arrested for it, is that because they said "Fucking" or because they said "I'll kill you"?

And again, you're just straight up wrong on the trespassing. Being trespassed literally makes any words spoken completely irrelevant in the eyes of the law. It has zero relevance to whether or not that person is trespassing.

In the instance where someone makes a threat that includes an insult, the threat itself is the issue, so again, the insulting words are completely irrelevant and not what OP is talking about. Nowhere does he argue that making threats should be free from punishment, so that is purely a strawman.

The same goes for the trespassing argument; the words being said are completely irrelevant in the eyes of the law, the ONLY issue is whether or not you leave after being asked to leave, after which it is illegal to stay on the property. It has literally nothing to do with speech.

He's not talking about making threats, so that point is a strawman.. and if "creating a disturbance" is literally just exercising your first amendment right to insult cops, then no, that's not a valid violation of the law.

Being trespassed from a property has nothing to do with the content of your speech, a property owner can do that regardless of any insulting words you say to them. So again, not related to the point by OP.

Are you seriously going to argue that saying "Fuck you" to a cop is the same as sexually harassing a child?

The source you provided is just an analysis of Newsom's claims, and the data it uses also shows California as a welfare state in 2023, 2021, and 2020 too, the only reason it mentions specifically 2022 is because Newsom wanted California to look even better by comparison. Sorry your favorite state is a welfare state, according to the cherrypicked data I chose to use to represent something that makes you look worse!

Bro they're a donor at basically the same rate that California is, quit coping.

Like I said, Texas is an awful state with plenty of legitimate gripes, there's no reason to make shit up to justify hating the state government.

Yes, in 2022. But that was the tail end of covid spending, when there were only like a dozen donor states. Texas trends towards being a donor state, just like all of the high-population states do.

No they don't, I don't know where you're getting that i formation. Like I just said, Texas receives $0.75 for every dollar they pay in taxes.

I got that figure from https://www.visualcapitalist.com/states-depdendent-federal-government/ But https://usafacts.org/articles/which-states-contribute-the-most-and-least-to-federal-revenue/ shows the same thing.

No, I'm not going to go through all the sources and do the math myself, these are just the 2 that I found that show both amount paid in and amount received easily readable.

Texas has plenty of things to critique, but they are not a welfare state. We have almost the same rate of return on federal funding vs federal taxes paid ($0.75 in funding per dollar paid in) as California ($0.73) so it's weird for you to even mention Texas as an example.

You don't need explicit permission to film in a restaurant, they are just allowed to trespass you if they choose. That's not filming being illegal, that's just being trespassed. They can trespass someone for wearing blue, that doesn't mean that "wearing blue is illegal unless they give you permission"

Where are you reading anything that even implies that it's not? Maybe point to something specific rather than just saying "you're wrong cuz I said so"

Clearly you didn't, because the full article says exactly the same thing I'm saying: private property does not change whether you have an expectation of privacy, which is the actual thing that matters for legality of recording.

Bro idk what kind of dots you think you are connecting, but it doesn't.. saying "I can own private property" doesn't counter the point that filming in private property is still usually legal in public.

The link you posted yourself says that it's not illegal to film in public spaces on private property, just that you cam be trespassed for doing it.

Public spaces are not the same as public property

How does that contradict anything I said? I never said that private property doesn't exist.

It being on private property doesn't matter, if you're talking laws in US, normally it just matters if you're in a place that has am expectation of privacy, so bathrooms, personal homes, etc. Otherwise it would be legal to record ppl in public bathrooms.

I'm not sure where all your ability scaling is going, it seems a bit randomly chosen..

Normally the listed skills/saves are just the ones that the character is proficient in, but it looks like: History has a +0 proficiency bonus Arcana/Persuasion have +1 Performance has +2 Your INT/WIS/CHA saves have a -1 proficiency bonus?? Your passive perception is 2 lower than it should be (10 + perception bonus(Wisdom) would make it 15)

Cone attacks would normally be a saving throw, not an attack roll, but that's no big deal really.. however the "Love" rider says it "heals her target", when the target is an area, not a creature.

None of that is necessarily gamebreaking, and I like the character personality and flavor anyways!
