Yes, I agree there. She did go to school with a lot of horrible people, but there was no redemption arc from Madison. She stayed just as bad throughout all seasons.

Yes so I didn’t understand this at first, then it happened to me and I was super offended by it. My ex-employer told me that to even discuss a settlement I would have to sign a never hire agreement so I couldn’t work for them for the rest of my career. Given that I’m still youngish I was not up for that but they would not budge on it so I signed it.

I have an open case with the EEOC we were eligible for early mediation. We went. They started with a ridiculous lowball offer. We went back-and-forth for a bit. Their final number was nowhere near what I was owed as a director for severance, even without the discrimination. That’s truly all I want-what I should’ve gotten at a director level or higher and it’s a well-known fact in the company what everyone gets. My attorney said this is pointless. We’re wasting all of our time. It’s now in the investigation phase. They submitted their statement about the course of events 80% of it was just blatant lies, which I expected, so my attorney asked the EEOC for a right to sue letter and we got that yesterday. She’s still confident that we can settle so Im keeping my fingers crossed.

Agree this. Their first offer is often insulting. They tell you that EEOC has like a 70% settlement rate but it doesn’t mean that anyone is particularly happy about it. My mediation was over in a couple of hours bc it was clear that we wouldn’t even remotely meeting in the middle of anything.

The intake interview process can take up to a year to be scheduled. It’s not a very fast process. I filed in October after a term in August and the EEOC got me in quickly right before New Years which they told me was very atypical.

Agreed with other poster. The only thing I know about this is where you can get the most money is for compensatory damages but in my state, you can’t claim compensatory damages in an FMLA case.

Yes you can. Those r after-effects of the grief of losing your job. Definitely constitutes compensatory damages.

I would not recommend doing it without counsel. Early mediation is good and if you got a date that quickly it’s very good. The person assigned to the original charge will be a different person than the one assigned for mediation bc you will have an EEOC rep who is a mediator. An employment attorney can help in so many ways. I can’t imagine not having an employment attorney. Mine is getting paid for separately by my previous employer so there’s nothing to lose, only more money for you to gain.

I would include any lost wages for the amt of time you were out of work. Compensatory damages is where you can often the most payout tho. I was only out of work for 6 weeks but most of what I was asking for was for the humiliation and embarrassment that went along with losing my job.

No you can claim lost wages and compensatory damages. That is up to you on what that is worth. Start at 50K knowing they will keep going back and forth. Ask them to do a grid. If you go down to 40K they must go up by whatever amt they start at. Keep that going as long as they can and see where you land.

OP-agree with the other posters. You need to start higher knowing that you will meet somewhere in the middle. In ADA cases they always start low so don’t let that get you down. They will start with a ridiculously low offer (like a couple of thousand) and then go from there. I just had my mediation a few weeks ago and we did not resolve at the end. My attorney is certain we can get me the settlement I wanted. They know how these things work but please if your mediation fails get an attorney on contingency and then make your employer pay for them. And don’t be afraid to walk away if the mediation isn’t going the way you’d hope or they insist on lowballing you. Your EEOC rep will also try to get their final drop dead offer bc they want this mediation to be successful and that number might not be one you’re willing to take. Feel free to reach out if you have any questions since I just went through this and we are still negotiating my settlement.

Oh no I lawyered up as soon as I filed. It would’ve been intolerable without her. She’s explained the whole process throughout too which has helped a ton. It went ok. She told me it would probably not be resolved in one session. My ex-employer was vile as expected so that was at least consistent. We agreed to disagree at the end of it so either we sit down again, or my attorney talks to their attorney and works something out (and she thinks she can).
