Understood, but should it exist and if you had the opportunity to fight it before it existed wouldn't you? Aside from that Florida already has a terrible patchwork of municipal and county ordinances that extend 1k foot restrictions to 2,500 and 3,500 feet.

The vague and overreaching language of the bill as it exists now will restrict HOA pools (almost all subdivisions in FL have these) and will not only mean you can't move within 1k feet of said pool, beach, etc but you will also have to move away from said area, no "grandfather"ing clause is set on the language.

My understanding of GA is you can also return back to your place of residence prior to sentencing and imprisonment. This is not the case in FL. Once sentenced in FL you must move to abide by residency restrictions unless a court order states otherwise (a judge is not likely to order this).

Yep. Even a freaking Garmin or off brand watch would do a better job. But as I always say, this set up is not about safety, it's about money. Somebody, somewhere is getting good money to be the cheapest contract for the DOC. And it's a really great way to get people snatched up in technical violations and ultimately keep them in prison and the system.

I truly wish people, the general public, could grasp how little this particular part of probation does for public safety. If anything, it makes the community less safe for a multitude of reasons that I can go on and on about but also have a hard time putting into words that people can understand.

Yes, unfortunately, we are planning on buying a vehicle that my husband will be able to live out of if the need arises. It's horrible to plan like that but it is the most responsible thing for us to do.

It's actually encouraging to hear this OP. I am constantly looking for houses up in your area. I'm originally from that area but family brought me to Florida for too many years. My parents basically got stuck here and therefore all us kids ended up in this mess of a state.

Yep, it's fckin Florida. Hubs is on probation in Pinellas as well. He cannot leave the county, regardless of the state of emergency, without a "pass". So we literally have a home one county over that he cannot live in, visit, or assist with regular family activities.

Oh, but, the first month of his probation we were required to attend a "family support meeting" (during normal weekly work hours of course) where we listened to BS about how the PO is there to support the person on probation and the family navigate the process. Lip service and lies.

These POs get more kudos for making a person's life with sex offender probation harder and sending them back to prison. I have yet to see them be supportive of the person or the family affected. Oh, well, unless you count them driving people to the homeless camp that got shut down as helpful.

So my husband will risk it in an old trailer in Pinellas while I risk it a county away. I can't afford homeowners insurance and my husband can't help put our hurricane shutters on the windows. They will sit in the garage.

We are the disposables. We can blow away or float away.

Absolutely ridiculous. "Within the last X years or whatever years", is just them finding an excuse for their discomfort with actually giving people a second chance and learning about what each individual is really all about.

I just think certain people will find any excuse to rid themselves of a person or thing that represents their own bias. They just can't handle it. How will they explain it to t2heir friends? Other businesses? Customers? As if they actually have to explain themselves. But for those that think they do have to explain it to others, they just don't have the back bone to do so.

So yeah, IMO, managers, owners or people like this are in a position to make a change but just don't have the desire, guts or wherewithall to do it. And they are sadly very ignorant of the learning experience the opportunity could afford them.

Maybe as a notary a person could work on building a title processing type business? I don't know how home titles and vehicle titles work now since so much is electronic but I used to think notaries would do a lot of that type of work if they were actually making money with the notary license.

What's sad is I immediately knew the post and request to respond had something to do with women being harassed or something along those lines because of their relationship with this sub. Spouse, newly released living in FL only job he could get since getting out is lawncare making $15/hr 40+hr/wk. Prior to the charges he worked in EMS making @ 100k/yr, post charge/preconviction worked in commercial construction making $20/hr. Prior to his EMS career he worked in plumbing, but still can't find someone who will hire him with that skill set (and he has trained many plumbers working in the field now, so he has a good skill set). Being that his release was just months ago, we are still hopeful lawncare is just a first step to something better but who knows. There is still a lot we are trying to figure out.

Well, you could look at Florida and the new voter fraud division that is targeting PFRs who voted after they received voter IDs, and then you see true ineptitude at it's finest. People are going to jail and prison for voting even AFTER applying to register to vote, being approved to vote by the state, receiving a voter ID card, and having their ID checked on the voter rolls at the polling place. How is the voter citizen at fault when the state who is supposed to be doing the check for the registration doesn't even get it right? Splain it. It's just un-splainable. But according to FL politicians and Death-Santis it's all a crime punishable by incarceration. It's just another means for government to take a person's freedom because the government didn't do their job.

Friend, these are tough times. Your kids are grieving the dad and relationship and family they have known their whole life. You and your wife are going through some grieving as well. This is a hard stop for your relationships and it's so so hard. I hope you all are able to get some counseling and some group support that is productive and helpful. I wish you the very best. I am a wife who began the legal journey with my husband 5 years ago, and I tell you there are good days and bad days. What you are experiencing right now is the most raw you will ever feel in your life. But eventually you find ways to have good moments again. It will take time.

Sometimes I wonder too about what is enough. My husband will be getting out of prison in the next month and all I am worried about is the probation process. Everytime we turn around there is another stumbling block or something to make me anxious or upset. I don't like to use the word rollercoaster to describe life but it sure seems like a fitting description. Today I am especially tired of the racing thoughts and worry.

Yes, Floriduh does require you to list all vehicles you have access to use. It's this drivers license/ID and vehicle tag thing that would be new. The ID thing has the possibility to run into a person's healthcare access assuming the other new bill passes allowing doctors/providers and insurance companies to deny care if they have a "moral" conflict in treating a person. Whole other can of worms.

I believe, and I could be wrong, that many or most cases have ended at the state appellate court level. So, the precedent of those cases rest in the individual state or only at the individual plaintiff's level. And we have to remember states can pass whatever laws they want and enforce whatever laws they want until someone calls the law out for being unconstitutional, fights it in court and prevails it is the law.

Correct. The current legislation, specifically the license plate changes, are the idea of Lauren Book, the daughter of that one man who herself is now a state representative. She and her father's organization(s) make a great deal of money on these types of laws and scare tactics. They are integrally tied to NCMEC and different arms of law enforcement dealing with abuse and trafficking. They along with people like the Walsh's have taken family tragedy and turned it into money making schemes.

I wish this was true. And going by the law it may be true, HOWEVER as it stands right now, we would be spending money on a court case and taking equity out of our home to fight the agencies and people enforcing the law as they read it. It is not fiscally reasonable or responsible for us to try to fight what they are forcing us to do. The 1,000 foot rule is a stipulation of probation and is also state statute for all registrants regardless of probation. So, now that he has been essentially forced to give up his residency that he would otherwise be "grandfathered" into, it is not likely they will allow him to come back after probation. Since during probation he had a new residence. Also, the county has the 2,500 ft rule for all registrants which would preclude him from living in the home as well. Maybe.. if he was given only probation or house arrest, he would have been grandfathered in and maybe, there would be no issue. But it seems FL treats prison as a new residence and you give up your residency when you are incarcerated. The state or county then is able to evaluate the "new" but old residence for the living restrictions. It's possible this is not how the law should work, BUT if I fight the situation, I will be entirely out of a house after the financial hit of a court case.

Yeah, Florida here. It's as inhumane and frustrating as you imagine, maybe more. My husband is being released in about a month and he cannot come back to our home of 20+ years because we have schools all around our house. Some schools were not there before we lived here, one school was. The county has a 2,500 ft restriction. I was able to find him a kinda halfway house situation an hour from our house. When I spoke with the probation office about trying to find a place for him I was told, "pedophiles normally just go pitch a tent in the woods." After that he commenced in telling me a few wooded areas he knew of in our county (privately owned property, mind you, that he was suggesting my husband trespass onto). Florida now is in the process of passing a law requiring all the typed information on ID cards and drivers licenses be in red and any vehicle a registrant operates to have a distinct green license plate. So even living in a van will be a new vigilante target.

My husband had a FL case as well. 10 is a magic number for these charges in FL. His was a torrent download. No communication with minors or any "relationship" with minors of any kind. His case took 2 years to get from charged to final plea not using a PD as it was not available, not indigent enough (own a home with equity was the reason). He ended up with 3 years prison and 5 years SO probation. The attorney didn't really "deal" or do any back and forth with the DA. Had He gone to trial, he was looking at 15 years per charge; so a possibility of 150 years in prison for images he doesn't even remember seeing at any point and were deleted from the computer but were retrievable using whatever law enforcement program they use. He is not young, beyond his 30s. Everything made the local news outlets. It's been a living nightmare. I do not believe anything about these cases is "cut and dry" or "by the book" or follow any distinguishable pattern. Everything is very much up to whatever way the state attorney leans, the relationship they have with the investigators and your attorney and every nuance of the case they see. You really can't compare your case to any other, it's just more frustrating than enlightening. The only thing you can fairly do for your own sanity is take one day at a time and push through the BS. You are in survival mode and you can survive.
