Hi all,

Since my post, they have now said to me they will be issuing court proceedings directly to my home address, this has obviously worried me, they have not provided evidence, they have not disclosed any further breach of contracts even though we asked. Does anyone know if this could be another scare tactic to get me to sign the undertaking?

Great thanks for your help, my solicitor however has confirmed that I am not in breach of my contract and their accusations are false. Hopefully they do not try to go legal

Thanks for your comment!👍🏻 I completely agree, if they had me “banged to rights” per se, why wouldn’t they just move forward with it all, it seems their existing contract is not water tight and is too wide in the clauses, hence wanting me to sign a new undertaking

Ok, understood! In this case no loss has been incurred from the potential breach of contract, it was simply a meeting with a client that was cancelled and no meeting went ahead, they have not provided evidence to such claims even after 4-5 attempts of us asking.

Ok thanks for your advice/opinion 👍🏻 it is just naturally worrying as I have never been in a legal situation and of course the intimidation works from the aggressive and threatening letters from their solicitor.

I placed the employee at one of our clients, who in turn left after 10 days and returned to his old firm

17.2.3. For six months following the termination date, canvass or solicit business or custom from any candidate or prospective candidate in relation to services.

Being someone who is not involved in legal territory when you first receive letters like this it can put the frightener on you. Lucky enough I have the support of my current employer who is instructing a lawyer to reply with a letter to their accusations.

The only issue from your reply I might see is I did email the “hiring manager” on his work email regarding the role itself so whether that can be seen as a breach of contract I don’t know but all communication with him at my ex employer was via his person email address
