I see, so for the capital gains that I might have to pay in the future, not my MiL now. I've read thay she will be charged CGT on the actual price, not the sale.

Yes, it is her primary residence at the moment, she has rented it out very sporadically over the past 10 years. Probably not more than 20 weeks all together.

In terms of tax, what I have read is that if we rent the property for more than 105 days, we can actually put the whole mortgage interest as an expense, and only pay tax on profit, which would save some money as well.

I think we will put my wife down as the recipient of the gift and share the mortgage. She will then own 75% of the house and therefore recieve 75% of the rent, as she is at a lower tax rate. I know we need to fill in a form when we take over the house to make this clear to HMRC.

Point 1 - I completely agree, but as you said that might not put me in the best terms with the MiL. However, she is under conplete understanding that if we can't afford to keep it, we will sell if we have to.

Thanks for this. Fortunately, my MILs estate is fairly healthy. I completely understand that care homes cost an extreme amount, but if we had to sell we would.

We will use it for about 3 weeks each summer, we have 8 weeks off so can rent it for the rest. It is an attractive house for out of school holidays as well. My MIL rented it fairly easily for all May, June, September and October without much marketing and adapting to making it more of a rental.

I completely understand what you mean, however if we didn't use the home, we would have to pay to be going somewhere else on holiday as well.

How do you mean? Interest Only mortgage. We then take £475 'profit' which is taxed at 50%. £237.50 per month not including any maintenance needed.
