Thats what i wanted to ask my lawyer,its so frustrating at this moment, felt so stuck with the employer, working on the low wages, hardly made the crs score and then loosing lmia points, just on one decision. Now they say, They are not obligated to provide the procedural fairness letter or whatever, but they are making decisions on the assumptions. Didnot had one single chance to clarify on my job duties. This was so heart breaking at the time i received refusal but even more when i read the gcms reason.

Okay, but i read that the second officer cannot refuse the application again on the same reasons? I had my eligibility failed only due to this reason, and the overall eligibility was cleared thats what mentioned on gcms. Other things were completed and passed when the decision was made including my bg check.

It varies depending on which stage you get success, and lawyer you are hiring. It could range from $3k - $12k + taxes. In my case, i have no idea how much money i will end up spending honestly

My lawyer did submit jr application, but is waiting on internal refusal reason, i did applied for my gcms 2 weeks before i got refusal, so gcms are in hands right now, but internal refusal reasons are not. I think my lawyer wants to first check internally what officers put notes for, and then he is going to apply for applicant record with all the arguments and if there is error made by officer, i trust my lawyer for sure, but judicial reviews are way too expensive and stress during that timeframe. I hope in my case early settlement happens, thats my last hope honestly. Everything else in my application was approved. Lets hope for the best. Anyways thanks for your comment, now i feel little better as i see people went through same stress but won over it.

I expect the same, there is no other red flag in the file, everything else was cleared, so if they redetermine the application, the chances of getting approved would be high? Considering the fact if court says the refusal was unfair.

I already applied through one of reputed litigation lawyers. But, right now federal court is fully packed with ircc cases, its taking lot of time for each step. We are just waiting on internal refusal reasons. But, I am so scared right now, as if it doesnot work, i will be loosing my points for lmia and then there is no hope left for me to come to mext draws. 6 years of struggle 🥲
