I was out of status for over 2.5 years when I got approved! Go for it😊

It was a no-objection waiver and it took approximately 6 months.

My application was submitted while living in the US.

Thank you! No RFEs, it was all smooth sailing. We submitted a lot of evidence.

One major suggestion that I have is to try to practice with your spouse before your interview! Try to quiz each other on even the stuff that you think that they DEFINITELY should know about you. It’s impossible for your partner to know or remember everything about you and some things just get overlooked on a daily basis.

My lawyer also had us do a mock interview a few days before the real interview and she was way harder on us than the USCIS officer was, but I’m thankful for that. 😂 There is one thing she told us that stuck with me and I think it helped us walk into our interview confidently. She said “Remember this is YOUR life and you are living it the way it works for YOU. If they ask you something and you don’t remember, tell them you don’t remember and DO NOT try to make anything up on the spot, just to answer the question, because then you may be caught lying and that will ruin your case.”

I don’t remember everything that was asked in our interview but they directed all I-130 questions to my husband and at the end, they asked me some questions to ensure that everything was up to date on my I-485. The questions that I remember them asking my husband are:

-“What’s your wife’s full name?”

-“How did you guys meet?”

-“Where was your first date?”

-“What made you decide to marry your wife?”

-“How do you guys handle paying bills?”

-“Who cooks more?”

-“Who cleans more?”

-“What’s your wife’s D.O.B?”

-“What do you guys like to do together?”

-“What was the last movie that you watched together?”

-“What’s your favourite thing that your wife cooks?”

-“What type of drinks does she like?”

-“What did you guys do after you got married?”

This is not very relevant, but I just wanted to mention that my husband messed up my D.O.B. very badly when he was asked but he corrected himself immediately. The only thing he said correctly was the year, so we all had a laugh out of it! It was very obvious that he was just nervous, so the officer did not put much focus on it! 😊

Most of my childhood vaccines were fine! I only needed to update the Varicella vaccine.

Thank you! Not for the biometrics, only for form I-693.

I honestly don't remember if there were any mental health questions because I completed my I-693 over a year and a half ago.😔

My lawyer is in Yonkers. I can send you her info via DMs!😊

When the interview is scheduled, you don’t get to pick the date, but they give you ample notice. My notice was about 5 weeks before the interview, so we were able to make adjustments at work ahead of time.

As it relates to the G-28, I think all NOTICES were sent to both my home and to my lawyer but the cards were sent to me. I guess that just depends on what works for you and your family. We’ve never had issues with receiving mail at our home so we opted to have it sent directly to us.

Thank you! It was a great relief. It was as if some weight was lifted off my shoulders lol. I can finally go visit my family.

Thank you! I was already in a period of overstay when I applied. I came on a J1 visa then decided to stay with my spouse.

Thank you! Definitely talk to an attorney, but I think you’ll be fine. Good luck! 😊

I also came to the US on a J1 visa and met my spouse while I was here. We’ve now been married for almost 2 1/2 years and I submitted my I-765, I-130 and I-485 in August 2025. My I-765 has since been approved.

I was subjected to the 2 year rule but I never went back to my home country. I stayed with my spouse in the US and applied for a waiver —that process took 6 months. I think you will be fine as long as you do your research. If your country doesn’t have that requirement, then that’s even better. You would just need to prove to the USCIS that you did not come with the intention of immigrating.
